Library Pictures. The Availability Date for each Library Picture shall occur on the date set forth in the applicable Avail Notice, as determined by Studio in its sole discretion. Notwithstanding the foregoing, the Availability Date for each Library Picture asset that is made available after the date hereof will be no later than any date afforded to any other distributor of such content on a DHE basis in the Territory.

Library Pictures. “Library Pictures” shall mean every feature length motion picture (a) that is initially released theatrically, direct-to-video, or on television in the Territory; (b) that was initially released in the Territory more than twelve (12) months prior to the then-current date or, in the case of a Sony Pictures Classics release, more than fourteen (14) months of the then-current date; and (c) for which Studio, its affiliates and/or film labels have the Necessary Rights.
