Common use of LIABILITY OF THE SUB-ADVISER Clause in Contracts

LIABILITY OF THE SUB-ADVISER. (a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements in the Fund's Disclosure Documents.

(a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements in the Fund's Disclosure DocumentsDocuments that are applicable or relate to the Sub-Adviser; provided, that the Sub-Adviser has had the opportunity to review any applicable Disclosure Document, that it incorporates any revisions provided by the Sub-Adviser in accordance with Section 7(c) and that the Sub-Adviser has had the opportunity to approve the final version of such Disclosure Document.

(a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements Approved Sub-Adviser Content contained in the Fund's Disclosure Documents.Documents that have been submitted to the Sub-Adviser for review and comment except to the extent Disclosure Documents do not faithfully reflect modifications or information provided by the Sub-Adviser pursuant to either of the last two sentences of Section 7(c)

(a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements in the Fund's Disclosure DocumentsDocuments relating to the Sub-Adviser and any Fund's investment objectives and strategies, provided that no changes regarding such matters are made to any applicable Disclosure Documents without the written consent or other acknowledgement of the Sub-Adviser from and after the time that such Disclosure Documents are reviewed by the Sub-Adviser.

LIABILITY OF THE SUB-ADVISER. (a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements in the Fund's Disclosure DocumentsDocuments relating to the Sub-Adviser and its affiliates, the Fund's investment strategies and related risks and any other information supplied by the Sub-Adviser for inclusion therein.

LIABILITY OF THE SUB-ADVISER. (a) The Sub-Adviser shall have responsibility for the accuracy and completeness (and liability for the lack thereof) of statements in the Fund's Disclosure DocumentsDocuments with respect to or about the Sub-Adviser or its management of the Fund.
