Liability of the County. The County Board, by the acceptance and performance of this Agreement does not assume any liability, and the Borrower hereby releases the County Board and any of its individual agents or employees from any such liability, and no claim shall be made by the Borrower upon the County Board or such employees or agents for or on account of any matter or thing.

Liability of the County. The County’s obligations to the CITY under this Agreement shall be limited to the terms and conditions set forth herein. Notwithstanding any other provision in this Agreement to the contrary, in no event shall the County be liable, regardless of whether any claim is based on contract or tort, for any special, consequential, indirect or incidental damages, including without limitation lost profits, arising out of or in connection with this Agreement or the services performed in connection with this Agreement.
Liability of the County. The County may not be able to fully or timely perform its obligation hereunder. By executing this MOU, the County commits only to participate as a cooperating agency to the extent that it reasonably determines to be feasible. No liability shall accrue to the County for failure to perform any obligation under this MOU, or for decisions made solely by Reclamation.

Liability of the County. The County shall not incur any responsibility in respect of the Bonds or this Agreement other than in connection with the duties or obligations explicitly provided herein or in the Bonds. The County shall not be liable to any Owner in connection with the performance of its duties hereunder, except for its own gross negligence or willful misconduct. The County shall not be bound to ascertain or inquire as to the performance or observance of any of the terms, conditions covenants or agreements of the Fiscal Agent herein or of any of the documents executed by the Fiscal Agent in connection with the Bonds, or as to the existence of a default thereunder. Under this Agreement, the following shall apply to the County:
Liability of the County. The Parties recognize that the County Clerk shall provide only specific services to the City and that the City is solely responsible for the conduct of the Election, including compliance with all applicable laws. To the extent permitted by law, the City agrees to indemnify and hold the County and its agents harmless from any and all claims, suits, expenses, damages or other liabilities, including reasonable attorney fees and court costs arising out of any claim by any person, persons, or entities as a result of the conduct of the Election.

  • LIABILITY OF OTHERS Nothing in this Contract shall be construed to impose any liability upon the Government to persons, firms, associations, or corporations engaged by Contractor as servants, agents, or independent contractors, or in any other capacity whatsoever, or make Government liable to any such persons, firms, associations, or corporations for the acts, omissions, liabilities, obligations and taxes of Contractor of whatsoever nature, including but not limited to unemployment insurance, gross receipt, excise, and social security taxes for Contractor, its servants, agents or independent contractors.
