Liability of the Contracting party. Notwithstanding what is established in the remaining clauses of this contract, the Contracting party shall be liable for any non-compliance with any of the obligations set forth in this contract. Specifically, the Contracting party shall be liable for any non-compliance with the duties of custody, secrecy and personal use of the identifier and the password(s) and signature. CaixaBank may terminate the Contract when it has knowledge of the same, without prior warning. Payment orders initiated with the details provided by the Contracting party shall be considered correctly executed in accordance with these details. As a result, CaixaBank shall not be liable for any incorrect or defective execution of these orders. The Contracting party shall also be liable for any non-payment of fees and costs derived from the services provided as a result of this Contract.

Liability of the Contracting party. Any financial loss or other damages incurred by Valorlux and which, fully or partially, directly or indirectly, are the result of any action of the contracting party, and in particular the result from its failure to duly comply with any of its obligations under this Agreement, will immediately lead to full compensation for Valorlux by the contracting party.

  • Responsibility of the Contractor The Contractor shall be responsible for the quality, technical accuracy, and the coordination of all deliverables and other services furnished by the Contractor under this Contract. The Contractor shall, without additional compensation, correct, or revise any errors or deficiencies in the Work which are discovered within a twelve-month period of final completion of Work.

  • Liability of the Parties 5.1. The Parties shall be liable for non performance or improper performance of their obligations under this Agreement in accordance with the legislation of the Russian Federation.

  • Where one Contracting Party or its designated agency has guaranteed any indemnity against non-commercial risks in respect of an investment by any of its investors in the territory of the other Contracting Party and has made payment to such investors in respect of their claims under this Agreement, the other Contracting Party agrees that the first Contracting Party or its designated agency is entitled by virtue of subrogation to exercise the rights and assert the claims of those investors.   • The Contracting Parties undertake to promote the exchange of visits by persons, groups and delegations from business, trade and industry, to facilitate contacts in the industrial, commercial and technical fields connected with trade and cooperation in textile industry and textile products and garments, and to assist in the organization of fairs and exhibitions of mutual interest.

  • Contracting Parties The Government customer (Licensee) is the “Ordering Activity”, “defined as an entity authorized to order under GSA contracts as set forth in GSA ORDER 4800.2G ADM, as may be revised from time to time.   • INDEPENDENT CAPACITY OF THE CONTRACTOR The parties intend that an independent contractor relationship will be created by this contract. The CONTRACTOR and his or her employees or agents performing under this contract are not employees or agents of the AGENCY.
