Letter Re. SKILLEDTRADES Contracting out: The Company acknowledges that the provisions of section of the Trades CollectiveAgreementare not applied consistently throughout all plants. In an attempt to resolve issues surrounding the outsourcing of Skilled Trades work, it is agreed that one person in each plant will be appointed by the company as a Contracting Out Coordinator to be held responsible to ensure the provisions of this Article are complied with. Training: The Company renews it’s commitment to ensuring the Skilled Trades employees covered by this agreement are brought up to kept current with training related to their trades. The Company furtheragrees tojointly develop a training matrix by July to ensure consistency throughout the Corporation. Any issues relative to ContractingOut or Training, as to above, that are unable to be resolved locally, may, as an exception to the normal process, be elevated to the Corporate Manager Employee Relations, Human Resources, or the Director of Operations. SkilledTrades Support,Forward Implementation Teams, Pilot Teams-Steady Requirements Appendix Supplementary Agreement Skilled Trades. All Skilled Tradesemployees volunteering for and who have enough seniority to be awarded, the steady day shift must de so for a 12-month term. If such employee wishes to cancel his term for any reason the month term has been completed it shall be incumbent upon that employee to find his own replacement for the remainder of the month term based on seniority. After the completion of the month term Skilled Tradesemployees that wish to stay on the shift must re-apply and all jobs will be assigned in order of seniority. Upon entering the steady day shift Skilled Trades employees will be initially assigned high hours in their respective classifications, and thereafter be credited overtime hours as set out in the CollectiveAgreement, when asked for overtime pursuant to Article Skilled Trades will not work on production coverage while on Projects on the steady day shift unless an emergency situation arises. Skilled Trades personnel on this shall receive daily work assignment from their Project Engineer Manager and report directly to such. Letter Re. Locomotive Video / Voice Recording (“LVVR”) Xxxxx Xxxxx General Chairman CTY CP-East Bombardier Transportation Montreal 00 Xxxxxxxx Xxxxxx North, Suite 109 Smiths Falls, ON K7A 2B2 Sir, This is with respect to our discussion on inward facing Locomotive Voice and Video Recording(LVVR) technology. The parties agree: Whereas the issue of LVVR has been a topic of discussion between Bombardier Transport Inc.(“Bombardier”) and Teamsters Canada Rail Conference (“TCRC”); And Whereas Bombardier and the TCRC have come to understand that although the technology is available for LVVR, the use of recordings is a difficult balance between the safety of the operation and personal privacy as well as working conditions in the locomotive cab; Now therefore the parties have agreed to a protocol that enhances the overall safety of operations of Bombardier while minimizing the impact on personal privacy and working conditions; Internal LVVR recordings can only be used at the request of the Transportation Safety Board for the purpose of incident/accident investigation. The review of LVVR footage or recordings by any other agency or individual is prohibited save and except for the employee of Bombardier who is required to retrieve the footage for the Transportation Safety Board. The LVVR recording cannot be reviewed by Bombardier or exo except as provided by law. In the event the government enacts legislation that enables Bombardier to utilize LVVR for other than review by the Transportation Safety Board only, the parties agree to meet with the assistance of TAT if necessary and discuss the terms and conditions governing such technology and the use of the information obtained through LVVR. The use of such technology, other than as permitted by law, shall not occur without the agreement of the parties. This letter of understanding will remain in force for the duration of the collective agreement.
