Letter of Attestation. Performing Agency shall provide HHSC State Hospital Central Administration with a letter of attestation by September 1 stating that all criteria listed in C.1 (Resident Roster) have been met for all assigned residents and that if any resident roster changes are made to the roster, written notification will be made to HHSC State Hospital Central Administration outlining the changes (within 14 calendar days) and attesting that all criteria listed in C.1 (Resident Roster) have been completed in response to documented changes.

For the avoidance of doubt, nothing in this Section 4 is intended to obviate any liability of the Sub-Adviser under this Agreement to the extent contemplated in Section 6.A. If requested by the Sub-Adviser, the Adviser agrees to have the Trust execute and deliver to the Sub-Adviser a separate form of Limited Power of Attorney in form and substance reasonably acceptable to the Sub-Adviser.
