Common use of Lessee Improvements Clause in Contracts

Lessee Improvements. Lessee shall not make or allow to be made any alterations or physical additions in or to the leased premises without first obtaining the written consent of Lessor, which consent shall not be unreasonably withheld. Any alterations, physical additions or improvements to the leased premises made by Lessee shall at once become the property of Lessor and shall be surrendered to Lessor upon the termination of this Lease provided that Lessee shall be entitled to retain the property listed on Exhibit A attached hereto, and provided further that, Lessor, at its option, may require Lessee to remove any physical additions and/or repair any alterations in order to restore the leased premises to the condition existing at the time Lessee took possession, reasonable wear and tear excepted, all costs of removal and/or alterations to be borne by Lessee. This clause shall not apply to moveable equipment of furniture owned by Lessee, which may be removed by Lessee at the end of the term of this Lease if Lessee is not then in default and if such equipment and furniture are not then subject to any other rights, liens and interests of Lessor.

Any alterations, physical additions or improvements to of the leased premises made by Lessee shall at once become the property of Lessor and shall be surrendered to Lessor upon the termination of this Lease provided that Lessee shall be entitled to retain the property listed on Exhibit A attached heretoLease; provided, and provided further thathowever, Lessor, at its option, may require Lessee to remove any physical additions and/or repair any alterations in order to restore the leased premises to the condition existing at the time Lessee took possession, reasonable wear and tear exceptedpossession other than the initial alterations agreed to by Lessor, all costs of removal and/or alterations to be borne by Lessee. This clause shall not apply to moveable equipment of or furniture owned by Lessee, which may be removed by Lessee at the end 12 of the term of this Lease if Lessee is not then in default and if such equipment and furniture are not then subject to any other rights, liens liens, and interests interest of Lessor.

Notwithstanding the foregoing to the contrary, if the Alterations (1) are or cosmetic nature such as painting, wallpapering, hanging pictures, millwork and carpeting; (2) are not visible from the exterior of the leased premises or the Building and (3) do not affect the Systems or the structural elements of the Building, then such no consent shall be required; provided that even if Lessor's consent to an Alteration is not required, Lessee shall still comply with this Section. Any alterations, physical additions or improvements to the leased premises made by Lessee shall at once become the property of Lessor and shall be surrendered to Lessor and become the property of Lessor upon the termination of this Lease provided that Lessee shall be entitled to retain the property listed on Exhibit A attached heretoLease. Provided, and provided further thathowever, Lessor, at its option, may require at the time of approval only, Lessee to remove any physical additions and/or repair any alterations in order to restore the leased premises to the condition existing at the time Lessee took possession, reasonable wear and tear excepted, all costs of removal and/or alterations to be borne by Lessee. This clause shall not apply to moveable equipment of or furniture owned by Lessee, Lessee which may be removed by Lessee at the end of the term of this Lease if Lessee is not then in default and if such equipment and furniture are is not then subject to any other rights, liens and interests of Lessor.

Lessee may add dock levelers, subject to the provision of this Section 6.02. Any request by Lessor pursuant to this Section 6.02 may also require Lessor to advise Lessee prior to such alterations or additions whether the removal thereof will be required at the termination of this lease.

Lessee Improvements. However, Landlord will require that any alterations, additions, or improvements be performed by a licensed, properly insured contractor approved by Lessor and all work shall be done in accordance with all applicable governmental rules and regulations. Any alterations, physical additions or improvements to the leased premises Leased Premises made by the Lessee shall at once become the property of Lessor and shall be surrendered to Lessor upon the termination of this Lease provided Lease; provided, however at the time Lessor consents to the improvements, Lessor may notify Lessee that Lessee shall be entitled to retain the property listed on Exhibit A attached hereto, and provided further that, Lessor, at its option, may require Lessee to must remove any physical additions and/or repair any alterations in order to restore the leased premises Leased Premises to the condition existing at the time Lessee took possession, reasonable wear and tear excepted, all costs of removal and/or and all alterations to be borne by Lessee. This clause shall not apply to moveable equipment of or furniture owned by Lessee, which may be removed by Lessee at the end of the term of this Lease if Lessee is not then in default and if such equipment and furniture are not then subject to any other rights, liens and interests of Lessor.

Lessee shall not make or allow to be made any alterations or physical additions in or to the leased premises without complying with all local, state and federal ordinances, laws, statutes and without first obtaining the written consent of Lessor, which consent shall not may in the sole and absolute discretion of Lessor be unreasonably withhelddenied. Any alterations, physical additions or improvements to the leased premises made by Lessee shall at once become the property of Lessor and shall be surrendered to Lessor upon the termination of this Lease provided that Lessee shall be entitled without credit to retain the property listed on Exhibit A attached heretoLessee; provided, and provided further thathowever, Lessor, at its option, may require Lessee to remove any physical additions and/or repair any alterations in order to restore the leased premises to the condition existing at the time Lessee took possession, reasonable wear and tear excepted, all costs of removal and/or alterations to be borne by Lessee. This clause shall not apply to moveable equipment of or furniture owned by Lessee, which may be removed by Lessee at the end of the term of this Lease if Lessee is not then in default and default, if such equipment and furniture are not then subject to any other rights, liens and interests interest of LessorLessor and such removal can be accomplished without material damage to the leased premises. Upon completion of any such work Lessee shall provide Lessor with "as built plans", copies of all construction contracts and proof of payment for all labor and materials.
