Common use of Legal Costs and Expenses Clause in Contracts

Legal Costs and Expenses. In respect of any event which may be the subject of indemnity under this Section We may pay at Our discretion: • solicitors' fees for representation at a Coroner's Inquest or Fatal Accident inquiry • the cost of legal services for defending a charge of manslaughter or causing death by dangerous driving • the cost of defending the Insured against any charge brought under The Corporate Manslaughter and Corporate Homicide Xxx 0000, up to a maximum sum of £5,000,000 in respect of any one incident for which indemnity is provided under this Policy • any other reasonable costs or expenses incurred in connection with an incident which may give rise to a claim under this Section. Where costs apply to both bodily injury and damage to property the costs will be allocated in the same proportions as the damages of each element represents to the total damages. We retain the right to appoint a solicitor of Our choice with regard to any of the above. Indemnity to Other Persons: We will also treat as insured under this Section: • any person permitted to drive on the effective Certificate of Motor Insurance while driving the Insured Vehicle on the Insured's reasonable instruction or with the Insured's permission • at the request of the Insured any person other than the driver travelling in or entering or leaving the Insured Vehicle • in the event of the death of any person entitled to indemnity under this Section that person's legal personal representatives • the owner of any Insured Vehicle loaned or hired to the Insured • any person with whom the Insured has entered into a contract ('the Principal') provided that:
