LEAVES OF ABSENCE - UNPAID. A. Leaves of absence without pay or benefits not to exceed one (1) year or the length of the employee’s seniority, whichever is less, without loss of seniority with accrual of seniority during the leave is available in accordance with Section B of this Article upon written request to the Superintendent.
LEAVES OF ABSENCE - UNPAID. A. The unpaid leave provisions of this Agreement shall be construed consistently with the requirements of the federal Family and Medical Leave Act. All unpaid leaves required by that Act shall be cumulative with, and not in addition to, any other applicable leave, paid or unpaid, provided for in this Agreement.
LEAVES OF ABSENCE - UNPAID. SECTION A - Child Care
LEAVES OF ABSENCE - UNPAID. A. Upon application, a unit member who has completed five (5) years in the Newark City School District may be granted a leave of absence, without pay, for not less than one (1) semester (or the balance thereof when the purpose is for child care leave) nor for more than three (3) semesters, except that a leave shall be granted when requested for medical reasons, child care or long-term care of an immediate family member (as defined in Article 22). The reason for the leave of absence must be provided to the Board of Education at the time the leave is requested. A unit member on an unpaid leave of absence may return to service only at the beginning of a semester. Upon application, a unit member who has completed one (1) year, but fewer than five (5) years in the Newark City School District, may be granted a leave of absence, without pay, for not less than one (1) semester (or the balance thereof when the purpose is for child care leave) nor for more than three (3) semesters, except that a leave shall be granted when requested for medical reasons, child care or long-term care of an immediate family member (as defined in Article 22), with the additional requirement that the unit member shall reimburse the Board for its portion of the required cost of retirement in the event the unit member elects to purchase the retirement credit. A unit member on an unpaid leave of absence may return to service only at the beginning of a semester. Any unit member who is granted an unpaid leave of absence more than once in any five years, shall only accrue seniority during the first unpaid leave during the five years and must reimburse the Board for its portion of the required cost of retirement for the second unpaid leave in the event the unit member elects to purchase retirement credit regardless of the unit member’s length of service.
LEAVES OF ABSENCE - UNPAID. 22.1 A leave of absence of up to one school year may be granted a member of the Bargaining Unit for family obligations or personal reasons. Return from such leave shall coincide with the start of a school semester. Such leave may be extended for one (1) additional year.
LEAVES OF ABSENCE - UNPAID. A leave of absence may be granted by the Board of Education to members of the bargaining unit pursuant to ORC 3319.13. An employee desiring such a leave shall present, in writing, a request stating clearly the reason and purpose of the leave to the Superintendent. The Superintendent shall report the request to the Board at the next regular meeting. Any employee who is on leave of absence and who wishes to return to his/her duties at the beginning of the following school year shall notify the Superintendent in writing of such intention not later than April 1. Upon return from a leave of absence, a teacher shall resume the contract status held prior to such leave and will be returned to a position for which he/she is qualified. Teachers using any Board approved leave of absence shall not lose seniority held prior to the leave, nor shall they gain additional seniority for the time on leave. If the employee desires to purchase the leave year for STRS credit, the employee will pay his/her share and the Board’s share of the contribution. “Contract status” means limited or continuing contract.
LEAVES OF ABSENCE - UNPAID. 104 Requests for leave must be made in writing no later than the due date for return of the teacher’s 105 contract for the following school year and will specify the duration of and the reason for the request. 000 Xxx Xxxxxxxx may grant up to one full school year of unpaid leave per request to a teacher. Up to two 107 teachers per year may be granted this leave. 108 Requests for leave for less than a school year will be granted only if the District is able to locate a 109 suitable replacement for the term of the leave. Leaves for less than a school year, including requests for 110 short leaves of one or more days, are at the discretion of the Superintendent and may be requested by 111 the teacher as needed. 000 Xxx Xxxxxxxx will guarantee a teacher on unpaid leave a teaching position in the District upon return, but 113 cannot guarantee the same position the teacher previously held in the District.
LEAVES OF ABSENCE - UNPAID. 1. Employees without sufficient sick leave to cover the period of disability, due to pregnancy, shall be entitled to unpaid leave for that portion of the period not covered by sick leave. All provisions and protections of the Family Medical Leave Act (FMLA) of 1993 shall be provided.
