Common use of Leases and Rents Clause in Contracts

Leases and Rents. All leases, subleases and other agreements affecting the use, enjoyment or occupancy of the Land and/or the Improvements heretofore or hereafter entered into and all extensions, amendments and modifications thereto, whether before or after the filing by or against Borrower of any petition for relief under 11 U.S.C. Section 101 et seq., as the same may be amended from time to time (the "Bankruptcy Code") (the "Leases") and all right, title and interest of Borrower, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code (the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

Leases and Rents. All leases, subleases leases and other agreements affecting the use, enjoyment or occupancy of all or any part of the Land and/or or the Improvements heretofore or hereafter entered into and all extensions, amendments and modifications thereto, whether before or after the filing by or against Borrower of any petition for relief under 11 U.S.C. Section ss. 101 et seq.. (the "Bankruptcy Code"), as the same may be amended from time to time (the "Bankruptcy Code") (the "Leases") and all right, title and interest of Borrower, its successors and assigns therein and thereunder, including, without limitation, all guarantees, letters of credit and any guaranties of the lessees' obligations thereunderother credit support given by any guarantor in connection therewith, cash or securities deposited thereunder under the Leases to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code (the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

Leases and Rents. All leases, subleases and other agreements agreements, whether or not in writing, to which Mortgagor is a party, affecting the use, enjoyment or occupancy of the Land and/or the Improvements heretofore or hereafter entered into and all extensions, amendments and modifications thereto, to the extent assignable, whether before or after the filing by or against Borrower Mortgagor of any petition for relief under 11 U.S.C. Section 101 et seq.the Bankruptcy Code (collectively, as the same may be amended from time to time (the "Bankruptcy Code") (the "“Leases"”) and all right, title and interest of BorrowerMortgagor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' ’ obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, payments in connection with any termination, cancellation or surrender of any Lease, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and and/or the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower Mortgagor of any petition for relief under the Bankruptcy Code (the "Rents") and all proceeds from the sale or other disposition of the Leases (the “Rents”) and the right to receive and apply the Rents to the payment of the DebtObligations;

Section § 101 et seq., as the same may be maybe amended from time to time (the "“Bankruptcy Code"”) (individually, a “Lease”; collectively, the "“Leases"”) and all right, title and interest of Borrowerthe Mortgagor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rentsrents (including all tenant security and other deposits), additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower the Mortgagor of any petition for relief under the Bankruptcy Code (collectively the "“Rents"”) and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the DebtSecured Obligations ;

Section 101 et seq., as the same may be amended from time to time Creditors Rights Laws (the "Bankruptcy Code"hereinafter defined) (the "Leases") and all right, title and interest of Borrower, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, room revenues, accounts, accounts receivable, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code Creditors Rights Laws (the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

Section §101 et seq., as the same may be amended from time to time (the "Bankruptcy Code") (collectively, the "Leases") and all right, title and interest of BorrowerGrantor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues royalties, issues, profits, income, revenues and profits other benefits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower Grantor of any petition for relief under the Bankruptcy Code (collectively, the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment and performance of the Obligations, including the payment of the Debt, as provided herein;

(the "Bankruptcy Code"), as the same may be amended from time to time (the "Bankruptcy Code") (the "Leases") and all right, title and interest of BorrowerXxxxxxxx, its successors successor and assigns therein and thereunder, including, including without limitation, all guarantees, letters of credit and any guaranties of the lessees' obligations thereunderother credit support given by any guarantor in connection therewith, cash or securities deposited thereunder under the Leases to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code (the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt, in each case together with the immediate and continuing right to collect and receive the same;

All leases, subleases including without limitation, Borrower’s interest as both landlord and tenant under the Master Lease (as defined herein), and other agreements affecting the use, enjoyment or occupancy of the Land and/or and the Improvements heretofore or hereafter entered into and all extensions, amendments and modifications theretointo, whether before or after the filing by or against Borrower of any petition for relief under 11 U.S.C. Section §101 et seq., as the same may be amended from time to time (the "“Bankruptcy Code"”) (individually, a “Lease”; collectively, the "“Leases"”) and all right, title and interest of Borrower, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rentsrents (including all tenant security and other deposits), additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code (collectively the "“Rents"”) and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

Section 101 et seq., as the same may be amended from time to time (the "Bankruptcy Code") (the "Leases") and all right, title and interest of BorrowerOwner, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower Owner of any petition for relief under the Bankruptcy Code (the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

All leases, subleases leases and other agreements (other than the Master Lease (defined below) and the Annex Sublease) affecting the use, enjoyment or occupancy of the Land and/or and the Improvements heretofore or hereafter entered into into(with the term “leases”, as used in this subsection and all extensionselsewhere herein, amendments and modifications thereto, whether before or after the filing by or against Borrower being deemed to be inclusive of any petition for relief under 11 U.S.C. Section 101 et seq.subleases, as sub-subleases or similar derivative estates to the same may be amended from time extent that the parties thereto are (or are deemed to time be) in contractual privity with Borrower) and any guaranty of any of the foregoing leases (each, a “Lease” or, collectively, the "Bankruptcy Code") (the "“Leases"”) and all right, title and interest of Borrower, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, whether paid or accruing before or after the filing by or against Borrower of any petition for relief under the Bankruptcy Code Improvements (the "“Rents") ”), subject to the license to collect and use such Rents pursuant to the provisions of Section 3.7 below, and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the DebtLeases;

Section 101 et seq., as the same may be amended from time to time (the "Bankruptcy CodeBANKRUPTCY CODE") (collectively, the "LeasesLEASES") and all right, title and interest of BorrowerMortgagor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower Mortgagor of any petition for relief under the Bankruptcy Code (collectively, the "RentsRENTS") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;

All leases, subleases lettings, licenses, occupancy agreements and other agreements affecting the use, enjoyment or occupancy of all or any part of the Land and/or and the Improvements heretofore or hereafter entered into and all extensions, amendments and modifications theretointo, whether before or after the filing by or against Borrower Grantor of any petition for relief under 11 U.S.C. Section §101 et seq., as the same may be extend, renewed, modified, replaced or amended from time to time (the "“Bankruptcy Code"”) (collectively, the "“Leases"”) and all right, title and interest of BorrowerGrantor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land and the Improvements, Improvements whether paid or accruing before or after the filing by or against Borrower Grantor of any petition for relief under the Bankruptcy Code (collectively, the "“Rents"”) and all proceeds from the sale or other disposition of the Leases and Leases, the right to receive and apply the Rents to the payment of the DebtObligations;

Leases and Rents. Section 101 101, et seq.. (the "Bankruptcy Code"), as the same may be amended from time to time (the "Bankruptcy Code") (collectively, the "Leases") and all right, title and interest of BorrowerMortgagor, its successors and assigns therein and thereunder, including, without limitation, any guaranties of the lessees' obligations thereunder, cash or securities deposited thereunder to secure the performance by the lessees of their obligations thereunder thereunder, and all rents, additional rents, revenues, issues and profits (including all oil and gas or other mineral royalties and bonuses) from the Land Land, the Improvements and the ImprovementsEasements, whether paid or accruing before or after the filing by or against Borrower Mortgagor of any petition for relief under the Bankruptcy Code (collectively, the "Rents") and all proceeds from the sale or other disposition of the Leases and the right to receive and apply the Rents to the payment of the Debt;Debt (as hereinafter defined); and
