Lease Exhibit. The only leases or other occupancy agreements to which Seller is a party or is bound affecting any Project are set forth in the Lease Exhibit attached hereto as Exhibit I (the “Lease Exhibit”). The Lease Exhibit shall from time to time be updated pursuant to matters permitted under the terms of Article 6, and each update shall not constitute a breach of warranties, provided that any new matters are permitted hereunder. With respect to each Project included in a Closing, at the Closing, Seller shall provide an updated version of the Lease Exhibit for attachment as an exhibit to the Assignment. With respect to each Lease set forth in the Lease Exhibit, (i) the Lease is in full force and effect and has not been further amended or modified except as otherwise set forth in the Lease Exhibit, or from time to time permitted under the terms of Article 6, and (ii) no Tenant has notified Seller, in writing: (A) requesting a reduction in the rent payable under the Lease, (B) advising Seller that the Tenant intends to assign its interest under the Lease, (C) requesting any modification or termination of the Lease or (D) indicating that such Tenant has commenced a voluntary case or has had entered against it an order for relief under the U.S. Bankruptcy Code (Title 11 of the United States Code).
Lease Exhibit. A" shall be ----------- superceded by the attached Exhibit "A-1" and all references in the Lease to ------------- Exhibit "A" shall change to Exhibit "A-1"; and (ii) the definition of Building 4 ----------- ------------ in Lease Section 2.(iv) shall be changed to read as follows: The term "Building 4" shall mean that single-story building consisting of 28,800 rentable square feet and all improvements therein, shown as Building 4 on Exhibit "A-1", ------------- commonly known as 000 Xxxx Xxxxxxxxxxx Xxxx, Xxxxxxxx Xxxx, Xxxxxxxxxx.
Lease Exhibit. A contains the separate legal description of the Subject Property. Except in conjunction with the Transactions, none of Seller or any of its Affiliates has entered into any material leases, subleases, licenses, concessions or other agreements granting to any party or parties the right to use or occupy all or any portion of the Subject Property, other than access easements for third party maintenance or service personnel in the ordinary course of business; the Subject Property is not subject to any commitment, right of first offer, or other arrangement for the sale, transfer or lease thereof to any third party (other than pursuant to this Agreement).
Lease Exhibit. Duke shall provide an updated version of the Lease Exhibit to CBOP and the Company to be attached as an exhibit to the Assignment at Closing. Lease Exhibit. The Lease Exhibit attached hereto as Exhibit D or any updated version thereof. Major Tenants. Showplace ICON Theatre, Cub Foods, Latitude 360, Anthropologie, Yard House, Bonefish Grill, Cxxxxx Irish Pub, Charming Charlie, Sxxxx X. Xxxxx Associates and Regus Corporation. Mode Lease. As defined in Section 18.18.
Lease Exhibit. There are no leases or other occupancy agreements (including any amendments and modifications thereto) affecting the Property other than as identified in the Lease Exhibit and the new leases entered into by Seller in accordance with this Agreement. Seller has provided to Buyer true, correct and complete copies of all Leases. Seller shall provide an updated version of the Lease Exhibit to Buyer as an exhibit to the Assignment. Seller has not entered into any Lease concerning the Property except with the Tenants disclosed on the Lease Exhibit. Seller has not delivered any notice of default to a Tenant that remains uncured except as set Forth on the Disclosure Schedule. Seller has not received any written notice of default from a Tenant in accordance with the terms of such Tenant's Lease with respect to any default by Seller thereunder that remains uncured, and Seller is not currently and actually aware of any default by Seller or a Tenant under a Lease which remains uncured, except as set forth on the Disclosure Schedule. To the best of Seller's knowledge, there are no grounds for any claim of a landlord default pursuant to the TK Lease.

Lease Exhibit. C" Whereas the Tenant wished to pay various Operating Expenses directly, Exhibit "C" of the Lease shall be amended to reflect the agreement that the Tenant is responsible for paying the following expenses directly: Building Maintenance Landscaping Maintenance Parking Lot Maintenance Snow Removal Sprinkler Maintenance The 1996 monthly estimated rate shall be adjusted accordingly at a revised monthly rate of $5,809.
Lease Exhibit. There are no leases or other occupancy agreements affecting the Property other than as identified in the Lease Exhibit and Seller has delivered to Buyer a true and complete copy of all Leases, including all amendments or modifications thereto. Prior to Closing, Seller shall provide an updated version of the Lease Exhibit to Buyer as an exhibit to the Assignment. Seller has not entered into any Lease concerning the Property except with the Tenants disclosed on the Lease Exhibit. Seller is not in default, and to Seller’s knowledge, no other party is in default, with respect to its obligations or liabilities under any of the Leases. Seller has not received any written notice from any tenant of the Property asserting or alleging that Seller is in default under such Tenant’s Lease, and Seller has not sent to any tenant of the Property any written notice alleging or asserting that such Tenant is in default under such Tenant’s Lease.
