Common use of Leadership and Governance Clause in Contracts

Leadership and Governance. (a) The Head of Education shall ensure an operational interface partnering agreement is put in place and agreed with the Governor describing how the education and custodial provision will work together to deliver improved outcomes for Young People. This agreement will include regular bilateral meetings between the Head of Education and the Governor. (b) The Contractor shall ensure that the Head of Education attends all SMT meetings held by the Governor and education managers attend strategic meetings as requested. (c) The Contractor shall work with the YOI to plan and manage the Services to ensure that delivery fits within the wider custodial environment of the YOI. (d) The Contractor shall ensure that the chair of the Activities Planning Board ensures that any escalated activity planning decisions are discussed and resolved by the Head of Custodial Services and the Head of Education, or escalated to the Governor within twenty-four (24) hours. (e) The Contractor shall liaise with and contribute to the work of YOI senior managers in developing Contractor policies and procedures aimed at ensuring the wellbeing, safety and security of Young People and the public, including SIRs, IEP schemes, care planning arrangements, segregation reviews and ACCT reviews, etc. 3. Risk and security management (a) The Contractor shall liaise with the Custodial Operator to ensure that there are suitable procedures and processes in place to enable the Contractor's Staff to share information about Young People's behaviour (or anything that might be considered pertinent to the management of an individual) with YOI custody staff following each morning/afternoon education session. (b) The Contractor shall work with the Custodial Operator to implement agreed behaviour management strategies to ensure there is a collaborative and consistent approach to behaviour management across the whole establishment. (c) The Contractor shall ensure that the Contractor's Staff understand their role within the context of the YOI's behaviour management strategy. (d) The Contractor shall ensure that all education courses and learning activities have due regard for YOI security and restricted use of materials within the YOI. (e) The Contractor shall ensure that the organisation of the Curriculum and its associated timetable adheres to: (i) the YOI's published movement times to and from morning/afternoon education sessions; and (ii) agreed movement times to and from lessons within each morning/afternoon education session. (f) The Contractor shall ensure that the Custodial Operator's mandatory security and Key Training (approximately three (3) hours) forms part of the induction for all of the Contractor's Staff. The Contractor acknowledges that the Contractor's Staff shall not be able to move unaccompanied within the YOI or work unsupervised with Young People until they have completed this mandatory training. (g) The Contractor shall ensure that the Contractor's Staff are available to supervise Young People from up to fifteen (15) minutes before the start of the morning/afternoon education session and are responsible for Young People following the end of each morning/afternoon session until they have been escorted elsewhere by custodial staff. (h) The Contractor shall ensure that all of the Contractor's Staff update P-NOMIS with information about Young People's behaviour (or anything that might be considered pertinent to the management of an individual), complete SIRs and ensure these are shared with the Security Team following each morning/afternoon session in order for the security team to be alerted of any potential security risks. 4. Young people's participation in education (a) The Contractor shall liaise with the Custodial Operator to agree the timetabling of PE lessons within the education morning/afternoon sessions to allow for each Young Person to receive thirty (30) hours of education activities each week. (b) The Contractor shall ensure that the Curriculum planning enables the agreed number of Young People to carry out cleaning (cleaning and catering at Wetherby YOI) duties as part of work experience linked to cleaning qualifications (cleaning and catering qualifications at Wetherby YOI) which shall be supervised by the Custodial Operator. (c) The Contractor shall liaise as required with the Custodial Operator to ensure that education is provided to Young People located on segregation units, bespoke units and to Young People whose movement within the YOI is restricted due to their risk or vulnerability factors. (d) The Contractor shall liaise with the Custodial Operator to implement strategies for re-engaging Young People who routinely refuse to participate in education provision or engage with their Personalised Learning and Skills Plan. (e) The Contractor shall liaise with the Custodial Operator and YJB to regularly review feedback on how the Outreach Education service is working and shall seek to continually improve the service provision and the management controls employed to improve the effectiveness of the system to ensure that Young People maximise their engagement in classroom education, minimise their time receiving Outreach Education and maintaining progress against their Personalised Learning and Skills Plan. (f) The Contractor shall participate in the Outreach Review. The Outreach Review shall be conducted within two (2) Payment Periods of the end of the Outreach Trial Period. (g) The Contractor shall liaise with the Custodial Operator to implement behaviour management strategies and ensure that IEP strategies are used for re-engaging Young People who are sent out or withdrawn from an education activity. (h) The Contractor shall liaise with the Custodial Operator to implement suitable procedures and processes to enable the Contractor to be informed of reactive decisions taken by the Custodial Operator which impact on a Young Person's participation in education activities. (i) The Contractor shall ensure that Young People's participation in education is not hindered by insufficient levels of Contractor Staff, including insufficient levels of staff due to sickness, leave or vacancies. (j) The Contractor shall work with the Custodial Operator to develop and maintain an integrated timetable of Young People's scheduled activities. The Contractor shall ensure that the timetable is shared on the prison service public drive so that all areas of the YOI have access and can identify when each Young Person is available during the Core Day. The Contractor shall ensure that a copy of the timetable is given to the Young Person on a weekly basis. For avoidance of doubt, where an Authorised Absence requires a Young Person to be escorted from and back to education, the duration of the absence will include the time taken to escort the Young Person from and back to education.
