Lead Generation. Agent or Agency, when performing lead generating activities shall inform the Beneficiary that the Beneficiary’s information will be provided to a licensed agent for future contact, or that the Beneficiary is being transferred to a licensed agent who can enroll him or her into a new plan.
1. When Agent or Agency is providing the Beneficiary’s information to a licensed agent for future contact, Agent or Agency shall inform the Beneficiary of such activity in accordance with the following standards:
a) Verbally when communicating with the Beneficiary through the telephone;
b) In writing when communicating with the Beneficiary through mail or other paper means; and
c) Electronically when communicating with the Beneficiary through email, online chat, or other electronic messaging platform.
2. When Agent or Agency is transferring the Beneficiary to a licensed agent, Agent or Agency shall disclose to the Beneficiary that the Beneficiary is being transferred to a licensed agent who can enroll the Beneficiary into a new Plan.
Lead Generation a. The Station may collect personal information from individuals on its platform(s) and generate leads, including, without limitation, by prompting individuals to provide information that may include the individual’s name, email address, phone number, city, zip code, birthday, and gender (such information collectively, the “Lead”). The Station will transmit the Leads to Advertiser or Agency as mutually agreed upon, and Advertiser or Agency agrees to pay the Station for any Leads delivered to Advertiser or Agency in accordance with the BILLING AND PAYMENT terms above.
b. As between the Station and Advertiser or Agency, the Leads shall be owned by Advertiser subject to the limitations set forth in this Agreement; provided however, Advertiser and Agency hereby grant the Station and its affiliates the perpetual, worldwide, fully paid, royalty-free right and license to use the Leads. Subject to Advertiser’s and/or Agency’s compliance with this Agreement, the Station grants Advertiser or Agency a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Leads solely in accordance with the terms of this Agreement. Advertiser and/or Agency shall only use the Leads (including any underlying personal information) for Advertiser’s own lawful business use, and in strict compliance with all applicable laws, rules, regulations, guidelines and principles issued by any governmental entity, and any recognized industry self-regulatory principles and standards relating to data protection, privacy, interest-based advertising, and consumer notice and choice about online marketing applicable in the location or region where Leads and personal information are collected, stored, used or processed (“Applicable Laws”), this Agreement and its privacy policy.
c. Subject to the foregoing license to the Station and its affiliates and except as expressly authorized under this Agreement, neither Advertiser nor Agency shall (or shall permit or assist any third party to) (i) sell, rent, market, lease, loan, license, modify, transfer, provide access to, disclose, assign, reproduce or sublicense the Leads to any third party; (ii) make derivative works of any Leads; (iii) collect, use, or disclose any Leads or personal information in a manner that violates any Applicable Laws; (iv) use the Leads or personal information in connection with the provision or sale of online behavioral or interest-based advertising or the development of individual profiles; (v) aggreg...
Lead Generation. Answers for Elders’ ultimate goal is to provide qualified leads to all Experts that are in our network. They are generated through various sources, including but not limited to: The Answers for Elders Care Line, The Answers for Elders Academy, Provider Alliance Referrals, Social Media Campaigns, and Radio Podcasts, Repurposing of Radio Content and Radio Advertising. We continuously look for new and unique ways to target family caregivers and seniors. Advertiser agrees that there are no guarantees on number of leads and does not hold the Company accountable for the quality, quantity, value or types of leads our program provides.
Lead Generation. If a lead generation component is part of the program, then subject to all the terms and conditions of this Agreement and applicable privacy laws, GlobalSpec will at a mutually agreed upon time deliver to Client, or provide Client with access to, information of each person who has signed up for a Client asset, including but not limited to on-demand Webinars and whitepapers, for applicable program components (“Lead(s)” and, collectively, the “Lead List”). For clarity, Client shall only receive the Lead List and does not, and will not, receive a copy of the program registration list or any registration list for a Website that may be a portion of the program. Unless otherwise specified herein, such Contacts with respect to any Webcasts or other online video or audio broadcasts shall include both live and on-demand Leads. Client represents and warrants to GlobalSpec that it will not sell or otherwise provide the Lead List, in whole or in part, to any third party, but instead shall use the Lead List solely for Client's own educational and self-promotional purposes; provided that such permitted use shall include Client's use of third-party marketing companies or other agents to accomplish such purposes as long as those companies agree to use the Lead List solely for the benefit of Client. Lead Generation. During the Transition Period and as more specifically provided in the Transition Services Agreement, Sellers shall, or shall direct their Affiliates or Representatives to: (i) maintain and operate the txxxx.xxx website accessible to those states where the Leased Locations are located in substantially the same manner that the website is immediately prior to the Closing Date; and (ii) at Buyer’s request, support Buyer in developing an approach for digital marketing tactics for the txxxx.xxx website for the states where the Leased Locations are located, provided, that the Buyer shall be responsible for the expenses related to clause (ii) above and any other amounts specifically provided for under the Transition Services Agreement. During the Transition Period, leads from the 1-800-TitanUp toll-free number in those states where the Leased Locations are located shall be provided by Sellers and/or their Affiliates to the Leased Locations in substantially the same manner and under the same conditions as they are provided immediately prior to the Closing.
Lead Generation. UtilityHound will provide Vendor client information for those clients who have agreed to set up services with the Vendor. The most affordable plan and service details must be included as a description of the Vendor’s services. Changes to this information can be made one-time per a month at no cost. Any additional monthly changes incur a $10 change fee, per notice given. Notice of changes must be provided at least 48 business hours before they take effect.
Lead Generation. (a) During the Term of this Agreement (as set forth in Section 5), Partner shall, if and when business opportunities dictate, generate sales and marketing leads and identify prospective customers who are interested or may develop an interest in purchasing any of the Products (“Leads”). Partner shall register the Lead with AccuKnox by emailing to it a completed lead generation form in the form attached as Exhibit A hereto (the “Lead Generation Form”). Each Lead Generation Form is subject to AccuKnox’s acceptance, which will be delivered via email as described below. No party assumes any liability for electronic mail deliveries that are not confirmed.
(b) Acceptance and registration by AccuKnox of any Lead as an approved candidate (a “Registered Lead”) may entitle Partner to receive a finder’s fee (the “Finder’s Fee”) in accordance with and subject to Section 4 below. Within ten (10) business days following its receipt of the Lead Generation Form, AccuKnox shall notify Partner, in writing via electronic mail, whether or not the Lead qualifies, in AccuKnox’s sole discretion, as a Registered Lead. All Registered Leads must be approved in writing by President or VP- Sales, AccuKnox. A Lead will not qualify as a Registered Lead if such Lead (a) is an existing account of AccuKnox (or any AccuKnox partner) as of the date the Lead Generation Form was submitted, (b) is an OEM or distributor of AccuKnox’s, or (c) has been previously contacted by AccuKnox, either directly or indirectly through a related person (such as a sales representative), company or a partner of AccuKnox, the purpose of which contact was to market any of the Products and Services to such Lead. An accepted Lead registration shall expire after one year from the date of registration (the “Registration Date”).
(c) Partner shall provide each Registered Lead with AccuKnox’s standard form of Software License Agreement (“SLA”). The prices, terms and conditions under which AccuKnox will offer or sell any Products shall be determined by AccuKnox in its sole discretion. AccuKnox shall have the authority to control all discussions and negotiations regarding any proposed or actual offering or sale of Products and Partner may not negotiate, modify, accept or sign the SLA on behalf of AccuKnox or collect payment of any fees due AccuKnox. Lead Generation. Dxxx will provide ideas on entry points to potential client relationships based upon his extensive contacts and knowledge of opportunities in the manufacturing arena. When appropriate, Dxxx will provide contacts information that Pelion will treat with great respect.
