Common use of Landlord’s Consent Required Clause in Contracts

Landlord’s Consent Required. Tenant shall not voluntarily or by operation of law assign this Lease, sublet all or any part of the Leased Premises, or otherwise transfer, mortgage, pledge, hypothecate, or encumber all or any part of Tenant’s interest in this Lease or in the Leased Premises or any part thereof (an “Assignment”), without Landlord’s prior written consent which consent shall not be unreasonably withheld. Any attempt to make an Assignment without such consent being first obtained shall be wholly void and shall constitute a breach of this Lease.

Landlord may condition such consent upon any assignee or subtenant providing Landlord with evidence of financial capability and restaurant operating experience satisfactory to Landlord. Any attempt to make an Assignment do so without such consent being first obtained in hand, shall be wholly void and shall constitute a breach of this Lease.

Landlord’s Consent Required. Tenant shall not voluntarily assign, mortgage, encumber or by operation of law assign transfer this Lease, or sublet all or any part of the Leased Premises, or otherwise transfer, mortgage, pledge, hypothecate, or encumber all or any part of Tenant’s interest in this Lease whole or in the Leased Premises part, nor grant a license or any part thereof (an “Assignment”)concession in connection therewith, without Landlord’s the prior written consent of Landlord, which consent may be withheld in Landlord's sole discretion. Any attempt to make an Assignment do so without such consent being first had and obtained shall be wholly void and shall constitute a breach of default by Tenant under this Lease.

No assignment or subletting, whether or not Landlord’s consent which consent is given, shall not be unreasonably withheld. Any attempt to make an Assignment without such consent being first obtained shall be wholly void relieve Tenant of its liability and shall constitute a breach of obligations under this Lease.

Any consent, and any attempt to make an Assignment do so without such consent being first had and obtained shall be wholly void and shall constitute a breach of this Lease.
