Landfill Gas. The scope of work for landfill gas compliance reporting includes: ♦ Conduct one site visit every month to monitor and collect data. ♦ Review landfill gas monitoring field data and update the master database(EQuIS). ♦ Conduct one site visit or staff walkthrough of the facility to overview gas equipment overview and system troubleshooting. ♦ Monitor and record landfill gas emissions data regularly to track any fluctuations in gas composition and output. ♦ Analyzing the collected data to ensure adherence to regulatory standards, identifying any anomalies or exceedances in emission levels. ♦ Prepare and submit monthly LFG field reports to the client quarterly. ♦ Implementing corrective actions as needed based on the data analysis to address any non- compliance issues promptly. ♦ Keeping an updated record of all monitoring activities and reports to maintain transparency and facilitate any future audits or inspections.
Landfill Gas. (A) Subject to paragraph (B), the Facility generates electricity solely from gas formed by the digestion of material in a landfill. (B) The Permitted Ancillary Activity Exception applies. (C) No Fossil Fuel is used at the Facility for the express purpose of it being used as a fuel (other than to undertake Permitted Ancillary Activities), unless it forms part of Waste from which the gas is produced.

Landfill Gas. The County, at its own cost, shall design, install, operate, and maintain a Landfill gas collection system necessary to allow the Landfill to comply with Applicable Law relating to air emissions from the Landfill. The Company shall cooperate with the County, shall provide reasonable assistance and will not materially interfere with the County's Landfill gas related activities. The County reserves the right to market commercial grade methane gas generated by the Landfill; provided that the County shall not materially interfere with the Company's performance of its obligations hereunder. Any and all costs of such marketing of such gas shall be borne by the County, including without limitation any and all increased costs incurred by the Company in its performance of the Contract Services directly caused by the County's Landfill gas collection and marketing activities.

Landfill Gas. The right and license to connect to the LFG Collection System, process, sell, and utilize the LFG that is generated from the Landfill and other contiguous landfill expansion areas and delivered to the Delivery Point(s) during the term of this Agreement. It shall be the Contractor's responsibility to connect to the LFG Collection System and, subject to commercially reasonable efforts, utilize all LFG made available by the County for processing and sale as a Beneficial End Use Product to an Energy Customer. Excess Gas shall be recovered in such a manner so as not to negatively impact Contractor’s operations or production and sales of Bendficial End Use Products. County and Contractor shall coordinate their efforts for Collection System work in the event that County installs or constructs any collection devices or performs maintenance to the Collection System. In the event County and Contractor cannot agree on the actions needed to comply with Applicable Law, the Contractor shall defer to County’s sole and absoute discretion. Nothing herein shall alleviate Contractor’s responsibility for compliance with all applicable laws nor limit or reduce the liability of Contractor to County under any other section of this Agreement Except as specifically provided in this Agreement, County reserves all rights to use the surface and subsurface of the Landfill; however, County shall use its best Commercially Reasonable efforts to minimize interference with the operations of the Conversion System or Systems.
Landfill Gas. The Contractor agrees to use commercially reasonable efforts to ensure that a state-of-the-art gas recovery system (which employs commercially reasonable methods to maximize capture of landfill gas and minimize flaring) is maintained at the Landfill, using best available control technology, for the duration of the Disposal Term. The Contractor shall use commercially reasonable efforts to ensure that the portion of the gas recovered from such system during the Disposal Term, attributable to tonnage Disposed at the Landfill pursuant to this Agreement, is used by the Contractor or its affiliates to produce energy or fuel vehicles, or is sold to third parties whom the Contractor reasonably believes intend to use such gas to produce energy or fuel vehicles or to transfer such gas to end users who intend to use it for such purposes. The Contractor and the Department of the Environment will cooperate in good faith to design and implement a plan to use such portion of Landfill gas in accordance with the preceding sentence, it being understood that such plan shall not conflict with
