Land Donation. Awardee shall, at the request of the Department, provide an appraisal of any real property or any interest in real property that is acquired through the transfer of title in fee from a Local Government to the State of California for activities related to development of the Selected Project. The value of the Land Donation will be the current appraised value of the property as supported by an independent third-party appraisal prepared by a Member Appraisal Institute-qualified appraiser within one year prior to the application deadline or DGS valuation.

Land Donation. If a density bonus is requested for a land donation meeting the requirements of Section 10-12-8 of this Chapter, the application shall show the following information regarding the land to be donated:
Land Donation. The Developer agrees to donate the Donation Property to the School Board subject to completion of the Due Diligence Period to the School Board’s reasonable satisfaction. The closing (“Closing”) of the donation of the Donation Property contemplated by this Agreement shall be consummated on the date that is the later of five (5) days following (i) 60 days after the date of this Agreement or (ii) the completion of the Due Diligence Period (as hereinafter defined), in each case regardless of the status of the Development Agreement or the Financing Contingency (the “Closing Date”). In the event the Closing Date specified is not a business day, the Closing shall be held on the business day next following such date. All expenses incurred by the Developer or the School Board with respect to this Agreement, including, but not limited to attorneys’ fees of the Developer or the School Board, shall be borne and paid exclusively by the party incurring same, without reimbursement. Real property taxes on the Donation Property shall be prorated as of the Closing Date based upon the latest available tax bill, which proration shall be final. Any documentary tax or real property transfer tax arising out of the conveyance of the Donation Property, the premium for the title insurance policy and any other fees and charges shall be paid by the School Board. The Developer shall obtain an appraisal of the Donation Property from a certified real estate appraiser (the “Appraisal”) prior to Closing. The value set forth in such Appraisal shall be the value of the Donation Property. It is understood that the Developer intends to claim a charitable deduction for the donation of the Donation Property as a charitable contribution to a qualified recipient organization under the provisions of Section 170(c) of the Internal Revenue Code and regulations thereunder for the year in which the Closing occurs. School Board agrees to reasonably cooperate with the Developer in the Developer's effort to claim a deduction for a charitable contribution related to the donation of the Donation Property and to provide the Developer with such documentation as the Developer may reasonably request relating thereto. Further, School Board shall provide a letter, on School Board’s letterhead, to Developer acknowledging the donation of the Donation Property and stating that no goods or services were provided or rendered in exchange for the donation.
Land Donation. (1) Within three (3) years of the Effective Date, or unless otherwise extended by the City Council, Xxxxxx Xxxxxx agrees to donate one half (0.5) acre to the City, or an entity designated by the City, for construction of forty-one (41) rental and owner- occupied Workforce House Units. These units count towards the Workforce Housing Requirement.

In the event that the Project or any Subproject does have any such impact, the Borrower shall take, or cause the Project Executing Agency or Project Implementing Agency to take, all steps required to ensure that the Project or Subproject complies with the applicable laws and regulations of the Borrower and with the SPS.
