Common use of Land and Improvements Clause in Contracts

Land and Improvements. There are no proceedings pending, or, to the best of Borrower's knowledge, threatened, to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding any part of the Land, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Land or the operation of the Facility in any manner. None of the Improvements is subject to any unrepaired casualty or other damage.

Land and Improvements. There are no proceedings pending, or, to the best of Borrower's ’s knowledge, threatened, to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding any part of the Land, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Land or the operation of the Facility in any manner. None of the Improvements is subject to any unrepaired casualty or other damage.

None of the Improvements is subject to any unrepaired casualty or other damage.

There are no proceedings pending, or, to the best of each Borrower's ’s knowledge, threatened, to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding any part of the Land, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Land or the operation of the Facility Facilities in any manner. None of the Improvements is subject to any unrepaired casualty or other damage.

None of the Improvements is subject to any unrepaired casualty or other damagedamage other than as previously disclosed to Lender in writing, including without limitation anything disclosed in the written reports of Property Solutions, Incorporated provided to Lender.

None of the Improvements is subject to any unrepaired casualty or other damagedamage other than as previously disclosed to Lender in writing, including without limitation anything disclosed in the written reports of any property inspections provided to Lender.

There are no proceedings pending, or, to the best of Borrower's ’s knowledge, threatened, to acquire through the exercise of any power of condemnation, eminent domain or similar proceeding any part of the Land, the Improvements or any interest therein, or to enjoin or similarly prevent or restrict the use of the Land or the operation of the Facility in any manner. None Except for unrepaired flood damage at the Axxxx Xxxx Facility, none of the Improvements is subject to any unrepaired casualty or other damage.
