Jury Duty/Crown Witness Leave. A seniority employee who is summoned and reports for jury duty, shall be paid by the Company an amount equal to the difference between the daily jury fee paid by the Court (not including travel allowance or reimbursement of expenses), for each day on which he/she reports for, or performs, jury duty, on which he/she otherwise would have been scheduled to work for the Company and, the wages that would have been earned by the employee from the Company by working during straight-time hours on such days. This clause will also apply in the case of an employee who was working afternoon or night shift, who has to report for jury duty or as a crown witness during non-scheduled working hours. Such employee will be granted his shift off with pay, the shift following or shift prior to the day he reports for jury duty or as a crown witness.

Jury Duty/Crown Witness Leave. 28.01 An employee who is selected for service as a juror or summoned as a Crown witness will be compensated for loss of pay from his regularly scheduled shift due to such jury or Crown witness service up to a maximum of two (2) weeks per contract year. Such compensation will be based on his regular hourly rate less the fee received for his services as a juror or Crown witness. However, should the employee present himself for selection as a juror and not be selected, then he is required, where circumstances reasonably allow, to return to the plant to complete his remaining normally scheduled work day.

Jury Duty/Crown Witness Leave. When an associate is required to serve on a Jury or as a subpoenaed Crown Witness, he shall be relieved of his duties for such time as it may require, and he shall be paid the difference between his fee as a Juror or Witness, and his earnings for the time lost, providing the associate furnishes the Company with a certificate of service signed by the clerk of the Court showing the amount of any fee received. It is the associate’s responsibility to come to work at anytime during the week that he is not actually required for Jury duty or to be present in Court.

Jury Duty/Crown Witness Leave. An employee who is selected for service as a juror or who is subpoenaed as a crown witness to appear in court, will be compensated for loss of pay from her regularly scheduled hours at her regular hourly rate less the fee received for her services as a juror or crown witness. However, should the employee present herself for selection as a juror and not be selected or be advised she is not required as a witness, then she is required to return to the Employer’s premises to complete her remaining normally scheduled work day. The employee must present to the Employer a copy of the subpoena or jury selection notice as well as the amount of pay received.
Jury Duty/Crown Witness Leave. 20.01 An employee required to serve on a legally constituted jury or subpoenaed as a Crown witness during a period when he would otherwise be scheduled to work shall be paid the wages he would have received during this period computed on the basis of his regular number of straight time hours and then the current rate of pay. Such employee will immediately notify the Company of the requirement to attend the Court and shall furnish adequate proof of the amount of pay received which shall be deducted from his next pay cheque. The Company will not require the employee to work any other than his regularly scheduled hours while on jury duty, or Crown witness, but may require an employee excused from jury duty or Crown witness to complete the balance of his regular shift.

The employee will provide evidence that s/he reported for jury duty or attended as a subpoenaed witness. It is the employee’s responsibility to come to work at anytime during the week that they are not actually required for Jury Duty or to be present in Court. Seniority and vacation accrual and benefits shall be maintained during Jury Duty/ Crown Witness/ work related Leave.
