Job Security and Outside Contracting. 6.1 The City is committed to providing regular budgeted positions for bargaining unit members and does not intend to privatize its workforce. No employee shall lose their employment as a result of contracting out work performed by bargaining unit employees. Any reduction of employees as the result of contracting out will be done through attrition or transfer of affected employees to comparable employment. This does not preclude layoff for other reasons including the termination of regular status employees for just cause.

Job Security and Outside Contracting. It is the policy of the Company, that outside contractors will not be utilized to perform work normally done by seniority employees.
Job Security and Outside Contracting. 6.1 Any work which is performed by bargaining unit employees shall not be contracted out until the City indicates that the contracting out will result in reduced costs. This does not restrict the City from contracting out work previously contracted. When contracting of work is being considered, the City shall withhold taking such action to provide the Union a reasonable opportunity for discussion of the matter, including alternate methods of performing the work. The City will provide all available cost comparison data to the Union(s) concerned based on uniform specifications. However, except for union contractors, available cost comparisons must include wage, health, welfare and pension costs comparable to those contained in this Agreement. The foregoing cost comparisons shall not apply to existing contracts and practices including those that may be renewed.
Job Security and Outside Contracting. It is the policy of the Company that employees of an outside contractor will not be utilized in the plant to replace seniority employees on production assembly or manufacturing work, warehousing work, or fabrication of tools, dies, jigs, and fixtures, normally and historically performed by them, when performance of such work involves the use of Company – owned machines, tools or equipment maintained by the Company employees. 492 This policy shall not affect the right of the Company to continue arrangements currently in effect nor shall it limit the fulfillment of warranty obligations by vendors nor limit the work which a vendor must perform to prove out equipment. 493 It is the policy of the Company to fully utilize its seniority employees in the performance of maintenance and construction work in accordance with the statement of policy established under the prior contract. It is the Company policy in all cases, except where time and circumstances prevent it, to have advance discussion with the local Union representatives prior to letting such a contract. In this discussion local Management is expected to review its plans or prospects for letting a particular contract. 494 The local Union should be advised of the nature, scope and approximate dates of the work to be performed and the reasons (equipment, manpower, etc., why management is contemplating contracting out the work. At such times, Company representatives are expected to afford the Union an opportunity to comment on the Company’s plans and to give appropriate weight to those comments in the light of all attendant circumstances. 495 In no event shall any seniority employee who customarily performs the work in question be laid off as a direct and immediate result of work being performed by any outside contractor on the plant premises. 496 20.02 Employees shall be permitted to smoke in those sections and areas of the plant premises which are not restricted against smoking because of safety or fire hazards.
Job Security and Outside Contracting. The Auditor’s Office occasionally has the need to complete work using contracted labor or professional expertise. The use of contracts generally augments work otherwise assigned to employees and does not result in layoffs. If the Auditor’s Office plans to contract out work that otherwise would be performed by bargaining unit employees, the Auditor’s Office will notify the Union before the contracting plan is executed, except when the Auditor’s Office determines that an emergency exists. In a non-emergency circumstance, the Union will have fourteen (14) calendar days to demand to bargain. If no demand to bargain is made, the Auditor’s Office may implement the contracting plan. If the Union demands to bargain, the parties will bargain under the provisions of ORS 243.698.

  • Security and Safety A. The Contractor warrants it is and shall remain in compliance with all applicable local, state and federal laws, regulations, codes and ordinances relating to fire, construction, building, health, food service and safety, including but not limited to the Hotel and Motel Fire Safety Act of 1990, Public Law 101-391. The Judicial Council may terminate this Agreement, pursuant to the termination for cause provision set forth herein, without penalty or prejudice if the Contractor fails to comply with the foregoing requirements.

  • Use, Security, and Retention Local Agency shall use, hold and maintain State Confidential Information in compliance with any and all applicable laws and regulations in facilities located within the United States, and shall maintain a secure environment that ensures confidentiality of all State Confidential Information wherever located. Local Agency shall provide the State with access, subject to Local Agency’s reasonable security requirements, for purposes of inspecting and monitoring access and use of State Confidential Information and evaluating security control effectiveness. Upon the expiration or termination of this Agreement, Local Agency shall return State Records provided to Local Agency or destroy such State Records and certify to the State that it has done so, as directed by the State. If Local Agency is prevented by law or regulation from returning or destroying State Confidential Information, Local Agency warrants it will guarantee the confidentiality of, and cease to use, such State Confidential Information.

  • UNION SECURITY AND CHECKOFF 5:01 It shall be a condition of continued employment for all employees including probationary employees, as defined in Article 2, to become members and maintain membership in good standing in the Union.

  • Network Security and Privacy Liability Insurance During the term of this Contract, Supplier will maintain coverage for network security and privacy liability. The coverage may be endorsed on another form of liability coverage or written on a standalone policy. The insurance must cover claims which may arise from failure of Supplier’s security resulting in, but not limited to, computer attacks, unauthorized access, disclosure of not public data – including but not limited to, confidential or private information, transmission of a computer virus, or denial of service. Minimum limits: $2,000,000 per occurrence $2,000,000 annual aggregate Failure of Supplier to maintain the required insurance will constitute a material breach entitling Sourcewell to immediately terminate this Contract for default.

  • UNION SECURITY AND CHECK-OFF 5.01 All present seniority employees who are currently members of the Union will be required to continue to be members of the Union as a condition of employment for the duration of this Agreement.

  • Records Availability and Retention Records of Contractor’s costs, reimbursable expenses pertaining to the Project and payments shall be available to Owner or its authorized representative during business hours and shall be retained for four (4) years after final Payment or abandonment of the Project, unless Owner otherwise instructs Contractor in writing.
