Common use of Issuance of New Common Stock Clause in Contracts

Issuance of New Common Stock. On or prior to the Issue Date, (i) JCC Holding shall have issued all shares of New Common Stock in accordance with and pursuant to the Plan of Reorganization and (ii) there shall have been delivered to the Trustee true and correct copies of the New Common Stock Documents.

Issuance of New Common Stock. On or prior to the Issue Initial Borrowing Date, (i) JCC Holding shall have issued all shares of New Common Stock in accordance with and pursuant to the Plan of Reorganization and (ii) there shall have been delivered to the Trustee Lender true and correct copies of the New Common Stock Documents.
