Investigations and Inquiries. Borrower hereby authorizes Lender to conduct such investigations and inquiries as to credit, operations of Borrower, the Mortgaged Property and Collateral as shall be necessary or desirable in connection with monitoring the Obligations, and all such persons of whom Lender may make such inquiry are empowered to cooperate with, and to provide requested information to Lender.

Borrower and Guarantor hereby authorize Lender to conduct such investigations and inquiries concerning Borrower, Guarantor, the Applicable Resorts, the Applicable Underlying Borrowers, the Applicable Underlying Guarantors, the Collateral, and the Applicable Underlying Loan Collateral as Lender shall, in its sole discretion, deems necessary or desirable in connection with its monitoring of the Loan and the Collateral therefor, and all such Persons of whom Lender may make such inquiry are empowered to cooperate with, and to provide all requested information to, Lender.
Investigations and Inquiries. Nether Parent nor any of its respective directors or officers is the subject of any investigation, inquiry or proceeding before the Securities Exchange Commission or any state securities commission or administrative agency.

If Syndax, or any other Project Participant receives (a) a notice from a Regulatory Authority that it plans to conduct an investigation covering, in whole or in part, data or other activities relating to the Study or (b) an inquiry or other correspondence from a Regulatory Authority regarding, in whole or in part, data or other activities relating to the Study, Syndax shall promptly forward any such notices, inquiries and *** INDICATES MATERIAL THAT WAS OMITTED AND FOR WHICH CONFIDENTIAL TREATMENT WAS REQUESTED. ALL SUCH OMITTED MATERIAL WAS FILED SEPARATELY WITH THE SECURITIES AND EXCHANGE COMMISSION PURSUANT TO RULE 406 PROMULGATED UNDER THE SECURITIES ACT OF 1933, AS AMENDED. correspondences to Genentech. Unless prohibited by such Regulatory Authority, Syndax shall allow Genentech to participate in any investigations or responses to such inquiry. For clarity, Genentech has no obligation to so participate, other than as expressly provided in the Agreement (e.g., under Section 2.7(b) and Section 2.9).
Investigations and Inquiries. Agent and its agents and representatives shall have the right once per six (6) month period (or more frequently if an Event of Default is outstanding) to conduct such investigations and inquiries as to the credit and operations of Borrower, each of the Guarantors and the Collateral as shall be necessary in connection with the Credits and monitoring of the Credits, and Borrower shall cooperate with Agent and provide Agent with such information reasonably requested by Agent in the exercise of such right and pay for the cost of such inquiry.

No member of the Group has received notification that any investigation or inquiry is being or has been conducted by any supranational, national or local authority or governmental agency in respect of the business or affairs of any member of the Group nor, so far as the Obligors are aware, are there any matters or facts which might reasonably be expected to give rise to such litigation or proceedings.

The Company hereby authorizes SPV, TFC and the Administrative Agent to conduct all such investigations and inquiries as to the credit and/or operations of the Company, any Affiliate of the Company, each Subject Person, each Resort and the Conveyed Assets as shall be necessary or desirable, in the sole discretion of SPV, TFC or the Administrative Agent, as applicable, in connection with its monitoring of the Loan Documents. The Company hereby agrees to cause any creditor of the Company to provide TFC or the Administrative Agent with credit information and references relating to the Company upon TFC's or the Administrative Agent's request and, by the above authorization, individuals of whom SPV or TFC may make any such inquiry are empowered to cooperate with and supply all requested information and documentation to SPV, TFC or the Administrative Agent, as applicable.
Investigations and Inquiries. Nether Parent, MMMB nor any of its respective directors, officers or managing members is the subject of any investigation, inquiry or proceeding before the Securities Exchange Commission or any state securities commission or administrative agency.
Investigations and Inquiries i. Except as set forth in the Disclosure Letter, there is no action, suit, investigation, examination, inquiry, audit, dispute, claim or assessment pending or threatened in writing with respect to Taxes of the Company or the Seller Parties.
