Common use of Interoperability Clause in Contracts

Interoperability. You may use your Transponder on any other California toll facility that allows payment of tolls via FasTrak. To make such use as seamless as possible, RCTC shares, among other things, Transponder identification numbers, account numbers, and the license plate numbers of vehicles listed on valid Accounts with the other toll facility operators in California. When you use your Transponder on another toll facility, the operator of that other toll facility will send us information about your transaction so that we can include the transaction on your Account statement. The information sent to us includes, but is not limited to, your Transponder identification number; your account number; your license plate number; the toll amount and/or other charges; and the date, time, and location of the toll transaction. If you use your Transponder on another toll facility that accepts FasTrak as a method of payment, you agree that we may charge you for any tolls, fines, and/or other charges arising from such use, and that you will be responsible to us or the other toll facility operator for such tolls and/or other charges. Tolls and other charges owed in this manner will be charged to your Account in accordance with rules, regulations, and procedures of the facility on which the transaction was recorded. You agree that we may provide the other toll facility operator with any information contained in this Agreement or any other information associated with your Account for purposes of collecting tolls, fines, and/or other charges, and that other toll facility operators may provide us with details of your usage of their facilities so that toll transactions can be included on your Account statement. If you fail to maintain your Account in good standing or to update your vehicle license plate(s) with us, you will be subject to toll evasion penalties and other charges as established by the other toll facilities you use.

Your usage of other interoperable toll facilities is subject to the terms and conditions es- tablished by that allows payment of tolls via FasTrak. To make such use as seamless as possible, RCTC shares, among other things, Transponder identification numbers, account numbers, and the license plate numbers of vehicles listed on valid Accounts with the other toll facility operators in California. When you use your Transponder on another interoperable toll facility, including any restrictions on payment methods accepted. • Subject to the operator of that other terms and conditions established by the interoperable toll facility, your transponder and/or license plate registered on your FasTrak account may be used to pay for tolls on any toll facility will send us information about your transaction so that we can include the transaction on your Account statementor other location cooperating with TCA. The information sent to us includes, but It is not limited tonecessary to obtain a separate transponder or account with the toll agency that operates the other facility/location. If you drive in a registered vehicle or a vehicle with your transponder, your Transponder identification number; your account number; your license plate number; or transponder may be read by the electronic processing equipment and if so, a record of your transaction will be created. Such trans- actions will be charged in accordance with the rules, regulations and procedures of that toll amount and/or facility or other charges; and the date, time, and location of the toll transactionlocation. • If you use your Transponder registered vehicle or transponder is used on another interoperable toll facility that accepts FasTrak as a method of paymentor other lo- cation, you agree that we TCA and/or the operator of the interoperable toll facility may charge xxxx you for any tolls, fines, and/or other charges arising from such use, and that you will be responsible to us or TCA and/or the other toll facility operator for all such tolls and/or other charges. Tolls and other charges owed in this manner will be charged to your Account in accordance with rules, regulations, and procedures of the facility on which the transaction was recorded. • You agree that we may provide and hereby consent to TCA exchanging with the other operator of an interoperable toll or park- ing facility operator with any whatever information contained in this Agreement or any other information associated with your Account TCA deems necessary for purposes of processing and collecting tolls, finesfees and/or violations. You also agree and hereby consent to the operator of the interoperable toll or parking facility sharing with TCA whatever information the operator of the interoperable fa- cility deems necessary for purposes of processing and collecting tolls, fees and/or other chargesviolations. This information may include, but is not limited to, transponder number, vehicle license plate number and state, date and time of transaction, toll facility, toll point location, lane, direction, occupancy, vehicle type, number of axles, and toll amount. • You agree to follow policies and regulations of all interoperable toll or other facilities that other toll facility operators may provide us with details of your usage of their facilities so that toll transactions can be included on your Account statement. If you fail to maintain your Account in good standing or to update your vehicle license plate(s) with us, you will be subject to toll evasion penalties and other charges as established by the other toll facilities you use.

Tolls and other charges owed in this manner will be charged to your Account in accordance with rules, regulations, and procedures of the facility on which the transaction was recorded. • You agree that we may provide and hereby consent to TCA exchanging with the other operator of an interoperable toll or park- ing facility operator with any whatever information contained in this Agreement or any other information associated with your Account TCA deems necessary for purposes of processing and collecting tolls, finesfees and/or violations. You also agree and hereby consent to the operator of the interoperable toll or parking facility sharing with TCA whatever information the operator of the interoperable fa- cility deems necessary for purposes of processing and collecting tolls, fees and/or other chargesviolations. This information may include, but is not limited to, transponder number, vehicle license plate number and state, date and time of transaction, toll facility, toll point location, lane, direction, occupancy, vehicle type, number of axles, and toll amount. • You agree to follow policies and regulations of all interoperable toll or other facilities that other toll facility operators may provide us with details of your usage of their facilities so that toll transactions can be included on your Account statement.
