Internet Warnings. If the Settling Entity offers for sale any of the Products to California consumers through websites such as xxxxxx.xxx that are not reformulated as set forth in subsection 2.2 above, it shall ensure that the required warning (with the language set forth in subsection 2.3 above) is prominently displayed to the purchaser prior to completion of the transaction without requiring the potential buyer to use considerable effort to be made aware of the health hazard advisory. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the online sale of the Products may appear either: (a) prominently placed on a webpage in which the Product’s photograph, price, or “add to cart” section are displayed; (b) on the same webpage as the order form for the Product; or (c) on any webpage displayed to the purchaser during the checkout process and prior to its completion for any purchaser with a California shipping address. The symbol “” may be placed adjacent to the signal word. The internet warning may use the Short-Form Warning content described in subsection 2.3(b). The URL "xxx.X00Xxxxxxxx.xx.xxx" in the Warning may be substituted with an equivalent reference to the official "Proposition 65 Warnings Website."
Internet Warnings. If the Settling Entity offers for sale any of the Products through online retail sellers, it shall ensure that the required warning (with the language set forth in subsection 2.3 above) is prominently displayed to the purchaser prior to completion of the transaction without requiring the potential buyer to use considerable effort to be made aware of the health hazard advisory. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the online sale of the Products shall appear either: (a) prominently placed on the page in which the Product’s initial photograph and price are displayed; (b) on the same web page as the order form for the Products; or (c) on the web page displayed to the purchaser during the checkout process. The Settling Entity may also place the symbol “” adjacent to “WARNING.” The internet warning may use the Short-Form Warning content described in subsection 2.3(b) if the warning provided on the product label also uses the Short-Form Warning content. The URL "xxx.X00Xxxxxxxx.xx.xxx" in the Warning may be substituted with an equivalent reference to the official "Proposition 65 Warnings Website," if the Settling Entity is prevented from including such URL in the appropriate location as agreed above in this paragraph.

The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the online sale of the Products shall appear either: (a) prominently placed on the page in which the Product’s initial photograph and price are displayed; (b) on the same web page as the order form for the Products; or (c) on the web page displayed to the purchaser during the checkout process. The Settling Entity may also place the symbol “” adjacent to “WARNING.” The internet warning may use the Short-Form Warning content described in subsection 2.3(b) if the warning provided on the product label also uses the Short-Form Warning content. The obligation to transmit online warnings extends to customers that offer any of the Products for sale in California.
Internet Warnings. If, after the Effective Date, Beniko sells Products via the internet to customers located in California, Beniko shall provide warnings for each Product both on the Product label in accordance with Section 2.4, and by prominently displaying the warning to the customer prior to completing the purchase or during the purchase of the Products without requiring customers to seek out the warning. The warning or a clearly marked hyperlink to the warning using the word “WARNING” given in conjunction with the sale of the Products via the internet shall appear either: (a) on the same web page on which the Product is displayed; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. The warning shall appear in any of the above instances adjacent to or immediately following the display or description of the Product for which it is given in the same type size or larger than the Product description text. The internet warning may use the Short- Form Warning content described in Section 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content.
Internet Warnings. If, after the Effective Date, Spire sells Products via the internet, through its own website, affiliated websites or a third party website, to consumers located in California or to customers with nationwide distribution and e-commerce websites, Spire shall provide warnings for each Product both on the Product label in accordance with Section 2.4, and by prominently displaying, or requiring the warning to be prominently displayed on affiliated websites, third party websites or by retail customers, to the consumer during the purchase of the Products without requiring customers to seek out the warning. The warning or a clearly marked hyperlink to the warning using the word “WARNING” given in conjunction with the sale of the Products via the internet shall appear either: (a) on the same web page on which the Products are displayed; (b) on the same web page as the virtual cart displaying the Products; (c) on the same page as the price for the Products; or (d) on one or more web pages displayed to a purchaser during the checkout process. The warning shall appear in any of the above instances adjacent to or immediately following the display, description or price of the Products for which it is given in the same type size or larger than other consumer information provided for the Products. The internet warning may use the Short-Form Warning content described in Section 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content.
Internet Warnings. For purposes of compliance with subsection 2.3 and 2.6, if after May 30, 2021, SFTZ offers for sale any units of the Product via the internet: (i) to customers that directly, or indirectly through other entities that SFTZ has reason to believe, sell to downstream persons in California; or (ii) to consumers in California, SFTZ shall provide warnings for each unit of the Product both on the Product label, and by prominently displaying the warning to the customer prior to completing the purchase or during the purchase of the Product without requiring the potential purchasers to seek out the warning. The warning (or a clearly marked hyperlink to the warning using the word “WARNING”) given in conjunction with the sale of the Product via the internet shall appear either: (a) prominently placed on the Product’s display page; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. The Settling Entity may also place the symbol “” adjacent to “WARNING.” The internet warning may use the Short-Form Warning content described in subsection 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content.

If, after the Effective Date, Burlington sells Products, that are not Reformulated Products, via the internet to customers located in California, Burlington shall provide warnings for each Product both on the Product label in accordance with Section 2.4, and by prominently displaying the warning to the customer prior to completing the purchase or during the purchase of the Products without requiring customers to seek out the warning. The warning or a clearly marked hyperlink to the warning using the word “WARNING” given in conjunction with the sale of the Products via the internet shall appear either: (a) on the same web page on which the Product is displayed; (b) on the same web page as the order form for the Product; or (c) on one or more web pages displayed to a purchaser during the checkout process. The warning shall appear in any of the above instances adjacent to or immediately following the display or description of the Product for which it is given in the same type size or larger than the Product description text. The internet warning may use the Short-Form Warning content described in Section 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content.

If, after the Effective Date, CMS sells Products, that are not Reformulated Products, via the internet, its own websites, affiliated websites or a third party website, to consumers located in California or to customers with nationwide distribution and e-commerce websites, CMS shall provide warnings for each Product both on the Product label in accordance with Section 2.4, and by prominently displaying, or requiring the warning to be prominently displayed on affiliated websites, third party websites or by retail customers, to the consumer during the purchase of the Products without requiring customers to seek out the warning. The warning or a clearly marked hyperlink to the warning using the word “WARNING” given in conjunction with the sale of the Products via the internet shall appear either: (a) on the same web page on which the Products are displayed; (b) on the same web page as the virtual cart displaying the Products; (c) on the same page as the price for the Products; or (d) on one or more web pages displayed to a purchaser during the checkout process. The warning shall appear in any of the above instances adjacent to or immediately following the display, description, or price of the Products for which it is given in the same type size or larger than other consumer information provided for the Products. The internet warning may use the Short-Form Warning content described in Section 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content. Where CMS sells, ships, or distributes Products to third-party retailers or e-commerce marketplaces, CMS will advise them of the internet Warning requirements under this Agreement as a condition of sale of the Products.
Internet Warnings. Internet warnings shall comply with Proposition 65 and the Implementing Regulations. If the Settling Entity sells any of the Products through online marketplaces, including through xxxxxxx.xxx, the Settling Entity shall provide the clear and reasonable warning to the purchaser prior to or during the purchase of the Product, as required by Proposition 65 and the Implementing Regulations. The Settling Entity may also place the symbol “” adjacent to “WARNING.” The internet warning may use the Short-Form Warning content described in subsection 2.3(b) if the warning provided on the Product label also uses the Short-Form Warning content as long as it is in compliance with Proposition 65 and the Implementing Regulations. The URL "xxx.X00Xxxxxxxx.xx.xxx" in the Warning may be substituted with an equivalent reference to the official "Proposition 65 Warnings Website," if the Settling Entity is prevented from including such URL in the appropriate location as agreed above in this paragraph.
Internet Warnings. In addition to the warning specified in Section 2.1 above, for all Products that Noticed Parties offer for sale directly to consumers in California via the internet, Noticed Parties shall provide a warning for such Products by including the warning set forth below in Section 2.3 on one or more of the following: (a) on the same web page on which a Covered Product is displayed; (b) on the same web page as the order form for a Covered Product;
