INTERNET DELIVERED SERVICES. The Company acknowledges that the LYNX Services involve use of the internet for the delivery of files and other information and for obtaining files and other information. The Company represents that it is aware of the processes implemented by the Bank with respect to the use of the internet in connection with the delivery of the LYNX Services and the Company agrees that such processes are commercially reasonable and acceptable to the Company even if such processes do not consist of the most recently developed technologies for such activities. The Company further acknowledges that the Bank does not and cannot control the flow of data to or from the Bank’s network and other portions of the internet and that the Bank is not responsible or liable for any delays, malfunctions or inconveniences resulting therefrom.

INTERNET DELIVERED SERVICES. The Company acknowledges that the OTM Services involve use of the internet for the delivery of files and other information and for obtaining files and other information. The Company represents that it is aware of the processes implemented by the Bank with respect to the use of the internet in connection with the delivery of the OTM Services and the Company agrees that such processes are commercially reasonable and acceptable to the Company even if such processes do not consist of the most recently developed technologies for such activities. The Company further acknowledges that the Bank does not and cannot control the flow of data to or from the Bank’s network and other portions of the internet and that the Bank is not responsible or liable for any delays, malfunctions or inconveniences resulting therefrom.
INTERNET DELIVERED SERVICES. The Remote Deposit Services involve use of the Internet for delivery of files and other information and for obtaining files and other information. Client represents that it is aware of the processes implemented by Bank with respect to the use of the Internet in connection with the delivery of the Remote Deposit Services, and Client agrees that such processes, including encryption, are commercially reasonable and acceptable to Client (even if such process, including encryption, does not consist of the most recently developed technologies for such activities). For any of the Remote Deposit Services utilizing the Internet, Bank does not and cannot control the flow of data to or from Bank's network and other portions of the Internet. Such flow depends in large part on the performance of Internet services provided or controlled by third parties. Actions or inactions of such third parties can impair or disrupt Client's connections to the Internet (or portions thereof). Bank cannot guarantee that such events will not occur. Accordingly, Bank disclaims any and all liability resulting from or related to such events and in no event shall Bank be liable for any damages (whether in contract or in tort) that are attributable to the public Internet infrastructure, Client's ability to connect to the Internet, or Bank's ability to connect to the Internet on Client's behalf.

INTERMEDIARIES The Bank may engage third parties to provide some or all of the Services. The Bank shall have no obligation to disclose arrangements with third parties to the Company or obtain the Company’s consent thereto. The Company authorizes the transfer of information relating to the Company to agents of the Bank for use in connection with the Services or as required by law. AMENDMENT The Bank may amend, revise or modify this Agreement at any time and from time to time in its sole discretion. The Bank will post the amended Agreement on the site used to access the Services, together with a notice that this Agreement has been amended. Any use of the Services following such notice will constitute the Company’s agreement to such changes. Further, the Bank may, from time to time, revise or update the applications, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Bank reserves the right to terminate this Agreement as to all such prior versions of the applications, services, and/or related material and limit access to only the Service's more recent revisions and updates.
