(ITAR) Seller agrees to notify BCM if any products and related materials to be provided to BCM by Seller pursuant to the Purchase Order are controlled for export pursuant to the export control laws and regulations for the United States and any applicable foreign country. Seller further agrees to provide the export classification of the controlled item(s), including the applicable Export Control Classification Number (“ECCN”) or U.S. Munitions List (“USML”) Category. Seller agrees that if it fails to notify BCM that it is providing export-controlled items, data, or services, it shall reimburse BCM for any fines, legal costs and other fees imposed for any violation of export controls.
