Intermittent or Reduced Leave. A. An Employee may take leave intermittently (a few days or a few hours at a time} or on a reduced leave schedule to care for an immediate family member with a serious health condition or because of a serious health condition of the Employee when “medically necessary”.

Intermittent or Reduced Leave. An eligible employee may take leave to care for a family member with a serious health condition on an intermittent basis, or on a reduced leave schedule, when a health care provider deems it medically necessary. This is also true if the employee is unable to perform the essential functions of his or her job because of a chronic serious health condition, even if the employee does not receive treatment by a health care provider. If an employee requests an intermittent leave or reduced schedule, the Employer may temporarily assign the employee to an alternative job with equal pay and benefits that better accommodates the recurring leave periods. The employee may also work reduced weekly or daily schedules to accommodate the recurring absences. Intermittent leave for the birth, adoption or xxxxxx placement of a son or daughter is available only with the mutual agreement of the employee and the Employer. Double Spouse Leave: When both spouses are employed by the State of Iowa and are eligible for leave under this Agreement, they are limited to a combined total of twelve (12) weeks of leave for the birth, adoption and xxxxxx placement of a son or daughter, or the care of a parent.

In the case of a documented medical necessity, an employee shall be entitled to intermittent leave and/or a reduced schedule that reduces regular hours per workday or workweek for purposes of the employee's or the immediate family member's serious health condition. The employee shall make a reasonable effort to schedule intermittent leave or leave on a reduced schedule so as not to disrupt the operations of the institution's applicable unit.

Coordination of leave accruals while on FMLA/CFRA An employee taking leave under the FCML policy shall be required to exhaust all sick leave prior to being authorized to take unpaid leave. All leave taken in coordination with FCML is computed toward the total 12-week allowance per year under FCML. Effect on benefits while on FMLA/CFRA Paid Leave During any period that the eligible employee takes paid leave under the provisions of this policy, the employer shall continue to pay the “employer” portion of the medical, dental, and vision insurance premiums; provided, however, that said employee was eligible for such county paid benefit prior to taking FCML. An employee shall continue to participate in and accrue benefits during any portion of the leave in which the employee remains in a paid status.

In the case of serious health conditions, leave may be taken intermittently or on a reduced leave schedule when medically necessary. Employees are expected to make a reasonable effort to schedule intermittent leave so as not to disrupt the operations of the Company. The Company may require an eligible employee on intermittent or reduced leave to transfer temporarily to an available alternative position for which the eligible employee is qualified if the position has equivalent pay and benefits and better accommodates the recurring periods of leave than the eligible employee’s regular position.
