INTERMEDIATE DISCIPLINE. 14.1 The District retains the right to discipline unit members for just cause. A course of progressive discipline shall include verbal warnings, written warnings, letters of reprimand, Disciplinary Notice without suspension, or suspension with pay. Progressive discipline does not apply where the serious nature of the offense may require the District to directly impose discipline. Disciplinary Notices issued under this Article that include suspension shall not exceed fifteen (15) days in duration. Denials of leave and involuntary transfers shall not be used for disciplinary purposes. Dismissals, non-reelections, or suspensions for more than fifteen (15) working days are governed by applicable Education Code and shall not be subject to the provisions of this Article. In the exercise of this right to discipline for just cause the District will not act arbitrarily, capriciously, or in violation of the terms of this Agreement or applicable provisions of the Education Code.

Progressive discipline procedures (verbal warnings, written warnings, letters of reprimand for placement in the unit member’s personnel file, suspension with pay, or suspension without pay for up to fifteen (15) working days in any one school year) shall apply except where the serious nature of the offense may require the District to directly impose a written warning, written reprimand, or suspension without pay. Discipline shall not include denials of leaves, involuntary transfers, dismissal, non-reelection, or suspensions for more than (15) working days. In the exercise of this right to discipline for just cause the district will not act arbitrarily, capriciously, or in violation of the terms of this Agreement or applicable provisions of the Education Code.
INTERMEDIATE DISCIPLINE. Discipline of employees shall be for cause as defined in the California Education Code, written Board Policies, District rules and regulations, and/or the terms and provisions of this Agreement. This clause does not apply to, nor does it limit, the District's rights to terminate employees pursuant to the Education Code, nor to the District's right to issue statutory letters of unprofessional conduct and/or incompetence. The District retains the right to terminate probationary and/or temporary employees and such activity is specifically excluded from the operation of this article and the grievance/arbitration procedure. Discipline includes the following: Oral reprimand, written reprimand, docking of pay, suspension without pay for up to 15 working days. The parties endorse the principle of progressive discipline subject to the following conditions: Progressive discipline contemplates that the level of discipline will fit the severity of the offense and, therefore, need not begin with the least serious form of discipline. The existence of forms of discipline short of termination in no way limits the District's authority to terminate employees pursuant to the Education Code. If an administrator schedules a formal meeting with a unit member, the administrator shall notify the unit member of the subject to be discussed. Any time an employee is to be interviewed concerning a matter, which the employee has reason to believe may lead to discipline, he/she has the right to request representation. Such right does not apply to conferences under Article 12, Evaluations, of this agreement, except as specifically provided for in Article 12. It is the employee's responsibility to request the representation. Management need not unreasonably delay the meeting in order to allow the employee to secure representation. Any notice of discipline shall inform the employee of his/her right to appeal through the grievance procedure and of his/her right to request Association representation.

  • SAFETY CONDITIONS OF EMPLOYMENT A. The District and its employees shall be safety conscious in their conduct and actions and shall cooperate in the implementation of the District's safety program.

  • Student Discipline CONTRACTOR shall maintain and abide by a written policy for student discipline that is consistent with state and federal law and regulations. When CONTRACTOR seeks to remove a student from his/her current educational placement for disciplinary reasons, CONTRACTOR shall immediately submit a written discipline report to the LEA and a manifestation IEP team meeting shall be scheduled. Written discipline reports shall include, but not be limited to: the student’s name; the time, date, and description of the misconduct; the disciplinary action taken by CONTRACTOR; and the rationale for such disciplinary action. A copy of the student’s behavior plan, if any, shall be submitted with the written discipline report. CONTRACTOR and XXX agree to participate in a manifestation determination at an IEP meeting no later than the tenth (10th) day of suspension. CONTRACTOR shall notify and invite XXX representatives to the IEP team meeting where the manifestation determination will be made.

  • Discipline for Cause No member shall be reduced in pay or position, suspended, removed, or reprimanded except for just cause. In the event of a grievance, employees shall appeal disciplinary actions which result in time-off without pay, or removal to Step Three of the grievance procedure within seven (7) calendar days after written notice of such action is served upon the affected member. Probationary removals or reductions are not appealable to the grievance procedure. Employees given written reprimands of record may, upon request, meet with the Chief Deputy and/or the Sheriff (or designee) to discuss the discipline. This meeting can be conducted with or without Union representation. The results of such meetings shall not be subject to appeal through the grievance procedure. If a member disagrees with the verbal or written reprimand, the member may write a memorandum to the Sheriff explaining the reason(s) for the disagreement. The memorandum will be attached to the reprimand.

  • Progressive Discipline The Employer will follow the principles of progressive discipline. Disciplinary action shall be commensurate with the offense. Disciplinary action shall include:

  • Discipline Disciplinary grievances will be initiated at the level at which the disputed action was taken.

  • Formal Discipline Continued unsatisfactory behaviors, or committing offenses of such serious nature that requires immediate expulsion from work, are subject to the formal discipline process. Formal discipline may consist of any one or combination of the following:

  • DISCHARGE OR DISCIPLINE 1. The Company shall have the right to discipline or discharge associates for just cause in accordance with the reasonable, established Company rules and regulations, which may be modified from time to time by the Company. In the case of the discharge of an associate, the Company shall furnish the discharged associate a signed statement giving the reason for discharge. The Company shall also email a copy of the signed statement to the President of Local 81408 as well as the representing xxxxxxx within three (3) business days.

  • School discipline The Parents accept the authority of the Headmaster and of other members of staff on the Headmaster's behalf to take all reasonable disciplinary or preventative action necessary to safeguard and promote the welfare of the Pupil and the School community as a whole. The School's policies on behaviour and discipline current at the time and published on the School website apply to all pupils at the School and at all times when the Pupil is in or at school, (including when engaged in online or remote learning), representing the School or wearing School uniform, travelling to or from School, on School-organised trips or associated with the School at any time. The policies shall also apply at all times and places in circumstances where failing to apply this policy may affect the health, safety or wellbeing of a member of the School community or a member of the public, have repercussions for the orderly running of the School or bring the School into disrepute.
