INSURANCE REQUIRMENTS. General- The Licensee shall before commencing performance of the Contract be responsible for providing and maintaining insurance coverage in force for the life of the Contract of the kind and in adequate amounts to secure all of the obligations under the Contract and with insurance companies licensed to write insurance in the Commonwealth of Massachusetts. All such insurance carried shall not be less than the kinds and amounts designated herein, and the Licensee agrees that the stipulation herein of the kinds and limits of coverage shall in no way limit the liability of the Licensee to any such kinds and amounts of insurance coverage. All policies issued shall indemnify and save harmless the Town of Burlington its agents and employees from any and all claims for damages to persons or property as may rise out of the performance of this Contract.
INSURANCE REQUIRMENTS. All events involving alcohol and all commercial renters/businesses must maintain and provide a Certificate of Insurance naming the West Hants Regional Municipality as an Additional Insured on a General Liability Insurance Policy or Special Events Insurance Policy. The insurance policy shall provide a limit of liability equal to or more than $2,000,000 per occurrence. The insurance must be from a licensed insurance company authorized to do business in the province. Any group who is represented by a provincial sport organizations (PSO) is encouraged to join and purchase the personal liability insurance provided by their PSO. A copy of your organization’s insurance policy naming the West Hants Regional Municipality as additional insured must be submitted before your application will be approved. INSURANCE OPTIONS Qualifying non-profit groups or individuals may purchase liability insurance as part of the User Agreement for a very reasonable price. We strongly recommend that individuals making bookings on behalf of a group invest in this option for your protection. INSURANCE REQUIRMENTS. The Consultant, at its own cost and expense, shall obtain and maintain in force during the term of this Agreement, the following insurance coverage: Commercial General Liability insurance all on an occurrence basis in an amount not less than $3,000,000 per occurrence limit per project/jobsite for bodily injury, property damage, personal and advertising injury and products/completed operations. Coverage is to include full contractual liability coverage. Worker's Compensation insurance in amounts required by law, and Employer's Liability insurance in the minimum of $500,000. Business Automobile Liability insurance including comprehensive third party coverage for bodily injury (including death) or property damage with a minimum combined single limit of $1,000,000 per occurrence including coverage for owned, non-owned and hired vehicles. Professional Liability Insurance including errors and omissions in an amount not less than two million dollars ($2,000,000) per claim and in the aggregate covering said services of this contract and shall be maintained for a minimum of two years following completion of all services under this agreement. The insurance requirements identified above shall not be construed to modify, limit or reduce the indemnifications requirements set forth herein. All such coverage shall be in a form and with insurers acceptable to University. Additional coverage may be required from time to time based on the scope of services provided by the Consultant. Each policy of insurance listed above must be evidenced by a certificate of insurance. The University must also be named as a primary additional insured for each line of insurance, except for (b) and (d). Coverage shall be not contributing with or in excess of any coverage University may carry. The required certificates of insurance shall be delivered, no later than five (5) days before Term of the Agreement commences to the: Office of Risk Management, University of Delaware, 000 Xxxxxxxx Xxxx, Newark, Delaware 19716. All such insurance shall be renewed at least thirty (30) days before the expiration of any certificate previously furnished. INSURANCE REQUIRMENTS. If Seller is to enter onto or otherwise perform work on Purchaser’s premises, upon demand of Purchaser Seller will be required to comply with Purchaser’s contractor insurance program. MISCELLANEOUS: Seller and Purchaser are independent contracting parties and nothing in the purchase order, including these Purchase Order General Terms and Conditions, shall make either party the agent, partner, joint venturer or legal representative of the other for any purpose whatsoever, nor does it grant either party any authority to assume or to create any obligation on behalf of or in the name of the other. The failure of either party at any time to require performance by the other party of any provision of the purchase order, including these Purchase Order General Terms and Conditions, shall in no way affect the right to require such performance at any time thereafter, nor shall the waiver of either party of a breach of any provision of the purchase order, including these Purchase Order General Terms and Conditions, constitute a waiver of any succeeding breach of the same or any other provision. If any term of the purchase order, including these Purchase Order General Terms and Conditions, is invalid or unenforceable under any statute, regulation, ordinance, executive order or other rule of law, such term shall be deemed reformed or deleted, but only to the extent necessary to comply with such statute, regulation, ordinance, order or rule and the remaining provisions of the purchase order shall remain in full force and effect.
