Insufficient Funding. COUNTY’s obligations under this Agreement are contingent upon the availability of local, state and/or federal funds. In the event such funding is reduced or eliminated, COUNTY shall, at its sole discretion, determine whether this Agreement shall be terminated. COUNTY shall provide CONTRACTOR seven (7) days advance written notice of its intent to terminate this Agreement due to insufficient funding.

Insufficient Funding. In the event that additional funding is needed to complete the Scope of Work, the TA will identify the additional amounts needed and review those estimates with the Sponsor. The Parties will work together to identify potential sources of funding, as well as obtain the necessary funds to complete the Scope of Work. If additional funding is needed due to a change in the Scope of Work, as requested by the Sponsor, the TA will identify the additional amounts needed and review those estimates with the Sponsor. Insufficient Funding. If the Funding provided by the County is insufficient to procure the Insurance required by this Agreement, the Coalition shall make reasonable efforts to raise additional funds through other means, such as donations, grants, fundraisers, or direct contributions from some or all property owners, with the goal of ensuring the Insurance is available for the property owners as contemplated herein. If such efforts are unsuccessful, the Coalition shall notify the County and the parties shall meet in good faith to discuss alternate means of providing insurance for the Vine Trail similar in nature and scope as the Insurance, including mitigation of any risks that may be increasing the cost of insurance. If the parties cannot agree on a means to provide comparable insurance for the Vine Trail, the parties shall proceed to mediation pursuant to section 11 with the goal of agreeing on a way to obtain insurance at a reasonable cost. The Coalition shall invite representatives of the property owners to participate in such conferences and mediation as and when they occur.
