Common use of Instruments in Writing Clause in Contracts

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire at least 66 2/3% of the aggregate number of Common Shares which may be acquired pursuant to all the then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, and the expression "extraordinary resolution" when used in this Indenture shall include an instrument so signed.

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Registered Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Registered Warrantholders entitled to acquire at least 66 2/3% of the aggregate number of Common Shares which may that could be acquired pursuant to all of the Warrants then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Registered Warrantholders in person or by attorney duly appointed in writing, and the expression "extraordinary resolution" “Extraordinary Resolution” when used in this Indenture shall include an instrument so signed.

Instruments in Writing. All actions which may be taken and all powers or rights that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 8 may also be taken and exercised by Warrantholders (who are entitled to acquire vote at such meeting) entitled to purchase at least 66 2/3% of the aggregate number of Common Shares which may be acquired purchased pursuant to all the then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, and the expression "extraordinary resolution" when used in this Indenture Agreement shall include an instrument so signed.

All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire at least 66 2/3% sixty-six and two-third percent (66⅔%) of the aggregate number of Common Shares which may be acquired pursuant to all the then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, and the expression "extraordinary resolution" “Extraordinary Resolution” when used in this Indenture shall include an instrument so signed.signed.‌‌‌

All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire at least 66 2/375% of the aggregate number of Common Shares which may be acquired pursuant to all the then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, provided that such instrument was submitted to all the Warrantholders for their prior consideration, and the expression "extraordinary resolution" when used in this Indenture shall include an instrument so signed.

All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire purchase at least sixty-six and two-thirds percent (66 2/3% %) of the aggregate number of Common Shares which may be acquired purchased pursuant to all the then outstanding Purchase Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by an attorney duly appointed in writing, and the expression "extraordinary resolutionExtraordinary Resolution" when used in this Indenture shall include an instrument so signed.

All actions which may be taken and all powers that may be exercised by the Warrantholders Warrant Holders at a meeting held as provided in this Article 7 8 may also be taken and exercised by Warrantholders Warrant Holders entitled to acquire at least 66 2/3% two-thirds of the aggregate number of Common Shares which may be acquired pursuant to the exercise of all of the then outstanding Purchase Special Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders Warrant Holders in person or by attorney duly appointed in writing, and the expression "extraordinary resolution" when used in this Indenture shall include an instrument so signed.
