INSTRUCTIONS FROM YOU. Any request of or instruction to us shall be in writing and shall be signed by any cardmember provided nevertheless that we may but shall not be obliged to accept and act on any instruction or request by telex, facsimile transmission or through the telephone which is believed by our offi cer or employee attending to such instruction or request to have been given or made or authorised by any cardmember. However, in doing so, we shall not be liable in respect of any negligence, wilful default or fraud by you. 3.3 We reserve the right not to act on any particular Client Instruction, and/or to make further reasonable enquiries before acting on a Client Instruction, where we consider it to be reasonably necessary to do so, including but not limited to where: 3.3.1 A Client Instruction cannot be verified to our satisfaction; or 3.3.2 Acting on the Client Instruction would result in a breach of one of the limits set out or referred to in these Terms and Conditions. 3.4 Where possible, we will notify you of any refusal to act or delay in acting on a Client Instruction. 3.5 We may (but are not obliged to) telephone you on a number we hold in our records to confirm or clarify a Client Instruction prior to acting on it if it is reasonable to do so, for example for reasons of security. In order to maintain the robustness of this security measure, we will only call you on numbers we already hold in our records.
INSTRUCTIONS FROM YOU. 15.1 You can use different methods to send us Instructions, as set out in paragraph 12 (Communication between us). Because you can do so via telephone and (where we inform you that you can) email, we may take certain steps to check these Instructions with you. 15.2 You must ensure you take all reasonable steps to keep your Security Details secure or secret, to prevent unauthorised use of them, and to carry out regular virus checks and security updates on any computer or telephone equipment you use to contact us. 15.3 Please contact us without undue delay if you think someone has your Security Details, if you suspect someone is impersonating you, or if you have lost your Security Details or they have been stolen. You may contact your Client Advisor or any member of our staff. 15.4 We may accept and act upon any Instructions purporting to come from you and which we believe to be genuine and which are given to us in a form of communication set out in paragraph 12 (Communications between us). For payment Instructions, we will assume you have agreed to us acting on your Instruction once we are satisfied of these matters or after your Confirmation under paragraph 15.6. 15.5 We may call you back to confirm any Instructions given by telephone or email (where we have told you that we will accept emails from you). If we do so you must confirm the communication in order for it to be valid. 15.6 Where you provide Instructions to enter into a Transaction by telephone or (where applicable) email: (A) if we have called you back to obtain Confirmation of your Instruction, your Instruction will be treated as having only been received by us when you have confirmed the Instruction; and (B) you agree that you will bear any Loss in the event that the Instruction is given by a person or persons purporting to be you and we shall not be liable for any Loss in these circumstances. 15.7 You may not withdraw any Instruction after the time when it has actually been received by us without our consent. However this does not affect your rights to revoke Instructions for payments from your Account, which are set out in paragraph 15 (Revoking Instructions for payments). 15.8 We may decline any Instruction to enter into a Transaction, without providing any reason or being liable for any Loss you suffer or incur resulting from that decision.
