Inspection by Tenant. Tenant shall have the right to inspect the on-going construction of the Project and the Contract Documents upon reasonable prior notice to Landlord. In addition, Tenant shall have the right to have an independent consulting architect, engineer or other appropriate consultant inspect the Project and the Contract Documents. Landlord shall cause Developer to provide Tenant’s Construction Representative with all updates of the status of the construction of the Project issued to Landlord in accordance with the Development Agreement.
Inspection by Tenant. During the course of construction of the Site and Shell Improvements and the Tenant Improvements, Tenant or Tenant's representative shall, at Tenant's sole cost and expense, at all times have the right to inspect the construction; provided that Tenant, in the exercise of such right, shall not unreasonably interfere with or delay the prosecution of such work (except to the extent such work is delayed by the necessity of remedying defective or incorrect work discovered by Tenant). No exercise by Tenant of its right to inspect the construction shall be deemed to affect the rights and obligations of Landlord and Tenant with respect to the work or any defects therein, nor shall such exercise be deemed an assumption by Tenant of any responsibility for the quality of the work.
Inspection by Tenant. During the course of construction of Landlord's work, Tenant or Tenant's representative shall at all times have the right to inspect the construction. Tenant’s failure to inspect the Subtenant Improvements shall in no event constitute a waiver of any of Tenant’s rights hereunder nor shall Tenant’s inspection of the Subtenant Improvements constitute the Tenant’s approval of same.
Inspection by Tenant. Tenant and Tenant’s agents shall have the right to inspect the Tenant Improvements at all times, provided however, that Tenant’s failure to inspect the Tenant Improvements shall in no event constitute a waiver of any of Tenant’s rights hereunder nor shall Tenant’s inspection of the Tenant Improvements constitute approval of the same. Should Tenant or Tenant’s agents disapprove any portion of the Tenant Improvements, Tenant shall notify Landlord in writing of such disapproval and shall specify the items disapproved. Any defects in the Tenant Improvements or deviations from the Approved Working Drawings shall be rectified by Landlord at no expense to Tenant.
Inspection by Tenant. From and after the date hereof, Tenant, its agents, employees, representatives, and consultants may enter the Buildings to inspect the progress of the Landlord Work and to determine if the Landlord Work is being performed in accordance with the requirements of this Lease, without being deemed to have taken possession; provided, however, that Tenant on behalf of itself, its agents, employees, representatives, and consultants agrees that neither Tenant nor its agents, employees, representatives, and consultants shall interfere with the Landlord Work.

Notwithstanding anything to the contrary in this Section 4.4, Tenant may only disapprove matters which are contrary to the Approved Working Drawings or are in violation of Laws. Any defects or deviations in, and/or disapproval by Tenant of, the Improvements shall be rectified by Landlord at no expense to Tenant, provided the same are noted by Landlord in a timely fashion so as to avoid unnecessarily causing Landlord to incur additional expenses due to said defect or deviation being covered up by subsequent work.
