Inspection Activities. The Municipality shall itself provide a qualified staff person, or retain a qualified person or entity, to serve as the Inspection Consultant to perform full- time Inspection Activities. The Municipality shall submit written documentation to the DOT indicating the criteria it used in assigning existing municipal staff, hiring new municipal staff, retaining an Inspection Consultant, or any combination of the foregoing to perform Inspection Activities for the Construction Project.

If the Municipality fails to provide adequate inspection, to the DOT’s satisfaction and in the DOT’s sole discretion, for any Construction Project during the construction phase, such may be deemed a breach of the PAL and the Master Agreement. In such instance, the DOT may require the Municipality to return Funding for the Construction Project, and exercise any other remedies available under this Master Agreement. The Municipality’s failure to inspect a particular Construction Project may result in the DOT withholding approval of the Municipality’s request to participate in future Grant and other DOT-overseen programs at DOT’s sole discretion.
Inspection Activities. Clause 20.1. Anatel shall inspect the service hereby granted in order to ensure the compliance with the universalization and continuity obligations inherent in the public system of its provision, as well as care for the compliance with the targets and commitments stated in this Agreement.

The purpose of this memo is to confirm that the function of Proveout Inspection currently has and shall maintain first rights to proveout inspection activities and to inspection activities related to the preparation of ISIR samples that they are capable of performing and are physically available to perform. As in the past and as in current practice, some activities related to proveout and to ISIR samples will continue to be performed by Quality Engineers, Process Engineers and Engineering students working in concert with proveout inspectors. The use of salaried personnel however in no way degrades from the proveout inspectors’ "first rights" and if required overtime rights to the aforementioned jobs. LETTER #27 LIFT TRUCK OPERATIONS IN PLANT II During recent collective bargaining negotiations, the Association and the Company agreed that pursuant to item 6 of the Paint Complex Technician job duties that the job shall include all material handling as defined in the schedule, except that at no time will the Paint Complex Technician be allowed to operate a lift truck to perform such material handling duties for other work in Plant 2. LETTER #28 PAINT COMPLEX TECHNICIAN During recent collective bargaining negotiations, the Association and the Company agreed that the Paint Complex Technician shall have the right to perform the duties of the Lubrication Service job classification insofar as it relates to the E-Coat Paint Complex, pursuant to the Supplemental Agreement for Letters of Understanding page 113, item number 7. LETTER #30 PRECISION COLD FORM TECHNICIAN During recent collective bargaining negotiations, the Association and the Company agreed that the Precision Cold Form Technician in Dept. 2237 and Dept. 1817 shall be responsible for all lubrication and to maintain oil levels for their specific operations during the week and on the weekends.
Inspection Activities. Purchaser shall have the right to enter upon Seller’s property at necessary times during business hours for the purpose of inspecting the Real Property. Except as provided herein, Purchaser shall be responsible for all inspections, examinations, tests and evaluations. Purchaser shall indemnify, protect, defend and hold Seller free and harmless from and against any and all claims, actions, causes of action, suits, proceedings, costs, expenses (including, without limitation, reasonable attorney’s fees and costs), liabilities, damages, and liens incurred by Seller by reason of the activities of Purchaser or its agents or contractors while upon the Property prior to the Closing or in exercising Purchaser’s rights hereunder. Purchaser shall repair any damage to Real Property that may be caused by Purchaser or its agents or contractors while on the Real Property performing its inspection or exercising Purchaser’s rights hereunder. During the Inspection Period, Purchaser’s liability insurance, in the amount of at least $1,000,000, shall name Seller and its directors as additional insureds, if requested. Such indemnity shall survive the Closing Date or earlier termination of this Agreement for a period of one (1) year. Notwithstanding the foregoing, Purchaser will not undertake any physically invasive tests of the Real Property without the prior written consent of Seller, which consent shall not be unreasonably withheld, conditioned, or delayed. Seller shall have the opportunity to have an agent or representative of Seller accompany Purchaser or its agents or contractors during Purchaser's access to Seller’s property or in connection with its contact with any employees or other third party business relations of Seller as provided under this Section.

Inspection Activities. Golder will provide field CQA inspection to verify that the liner system is constructed in accordance with the construction plans, specifications, and CQA Plan. Accordingly, we will observe and document the following: Review contractor submittals Conformance testing of the geosynthetic materials Sample collection and testing of soil materials Observation of geosynthetics deployment and installation including trial seams, seaming, and non- destructive testing as specified Electrical leak detection testing of the geomembrane component of the alternative final cover Golder will be on-site full time during the work to complete the base liner construction. We have assumed that this work will be completed by the contractor during 10-hour work days, six days per week, for a total of 100 working days. We have budgeted for one full time CQA technician for the entire construction and a second CQA technician for 50 percent of the time. We have assumed that the County will be potholing the existing soil cover to determine adequate soil to be used as the foundation layer for the closure system. Should areas of inadequate soil cover be determined, Golder will have to update our cost estimate based on required amount of additional testing that will be required for placement of the foundation soil.
Inspection Activities. The Division of Water Pollution will continue to implement a field inspection program to meet its NPDES program administration responsibilities. The inspection program will prepare and implement an annual inspections plan consistent with the USEPA National- National Compliance Monitoring Strategy which reflects current USEPA Inspection Frequency Guidance, acknowledging that additional resources will be needed for Illinois EPA to fully implement the Strategy, ICIS-NPDES Policy Statement and Wet Weather SNC definition. The annual inspection plan will be prepared and submitted to Region 5 by September 30 each year. The annual inspection plan will include inspection projections for the coming year as well as a brief assessment of the successful implementation of the previous year’s plan relative to consistency with the USEPA National Compliance Monitoring Strategy. Region 5 will review and provide comments consistent with national strategy within 30 days of receipt of the plan. For FY 2010, the inspection plan will reflect changes from the 2009 annual inspection plan as follows: o The frequency of inspecting Major dischargers that have a good compliance history will be slightly reduced, and resources will be diverted to inspections of wet weather sources. A specific list and schedule of Major discharger inspections will be transmitted to Region 5 by September 30, 2009. o Reconnaissance inspections by sampling technicians will continue to be an important element of the inspection program. These inspections include a brief overview of treatment plant operating conditions and collection of an effluent sample, providing a significant increase in our on-site presence. Unfortunately, vacancies have reduced inspection coverage from past years. o Agreements are in place with Soil and Water Conservation Districts (Districts) covering eighteen counties for inspections of NPDES-permitted construction. The primary role of the Districts is to provide on-site technical assistance to developers and contractors. In addition, Districts work closely with regional office staff to identify problem sites which are then designated as priority sites for Illinois EPA compliance inspections. o Field staffs are reviewing CSO Long Term Control Plan reports. CSO inspections consistent with FY09 SRF program review recommendations will frequently be conducted in conjunction with those reviews. o Field staffs are also reviewing CAFO NPDES permit application materials and will conduct field ...
Inspection Activities. 5.1.1. Seller shall use commercially reasonable efforts to cooperate with Purchaser’s continued due diligence of the Interest and the Hotels; provided, however, that Purchaser shall have no right to terminate this Agreement, nor a right of set-off or reduction of the Purchase Price, as a result of such diligence.
