Common use of Independent Consultant Clause in Contracts

Independent Consultant. It is understood and agreed that Consultant, in the performance of the work and services agreed to be performed by Consultant, shall act as and be an independent Consultant and not an agent or employee of City, and as an independent Consultant, shall obtain no rights to retirement benefits or other benefits which accrue to City's employees, and Consultant hereby expressly waives any claim it may have to any such rights.

Independent Consultant. It is understood Consultant and agreed that Consultantall person(s) employed by or contracted with Consultant to furnish labor and/or materials under this Agreement are independent contractors and do not act as agent(s) or employee(s) of City. Consultant has full rights, however, to manage its employees in the their performance of the work and services agreed Services under this Agreement. Consultant is not authorized to be performed by Consultant, shall act as and be an independent Consultant and not an agent or employee of City, and as an independent Consultant, shall obtain no rights bind City to retirement benefits any contracts or other benefits which accrue to City's employees, and Consultant hereby expressly waives any claim it may have to any such rightsobligations.
