Increase in Base Rent. To reflect the increase in rentable square footage under the Lease, the table in Section 1.11 of the Lease is deleted and the table set forth on Exhibit Rent, attached hereto and made a part hereof shall be inserted as the table of Base Rent in Section 1.11. Furthermore, in the event Expansion Space Four becomes a part of the Premises pursuant to Section 2 of this First Amendment, there shall be payable as additional Base Rent (that is, in addition to the Base Rent payable pursuant to Exhibit Rent) the Base Rent set forth in Exhibit Space Four Rent, attached hereto and made a part hereof. In the event of a delay in the First Expansion Date, Second Expansion Date, Third Expansion Date or Fourth Expansion Date by reason of a delay in delivery of a space as described above, the Base Rent (on a per day, per square foot basis multiplied by the square footage of the space delivered late) with respect to such late delivered space shall not be payable with respect to the period of the delay.
Increase in Base Rent. To reflect the increase in rentable square footage under the Lease resulting from the Substitution and the satisfaction of the conditions relating to the addition to the Premises of Expansion Space Four, the table in Section 1.11 of the Lease (as amended in the First Amendment) is deleted and the table set forth on Exhibit Rent, attached hereto and made a part hereof, shall be inserted as the table of Base Rent in Section 1.11. Exhibit Space Four Rent in the First Amendment is deleted and of no force or effect, the rents set forth therein having been incorporated in Exhibit Rent attached hereto. In the event of a delay in the Second Expansion Date or the Third Expansion Date (the delivery conditions for the First Expansion Space and Expansion Space Four having been satisfied) by reason of a delay in delivery of a space as in the First Amendment, the Base Rent (on a per day, per square foot basis multiplied by the square footage of the space delivered late) with respect to such late delivered space shall not be payable with respect to the period of the delay and shall be abated to the extent provided in Section 1.C(x) of the First Amendment with respect to a delay in the Second Expansion Date and to the extent provided in Section 1.D(x) of the First Amendment with respect to a delay in the Third Expansion Date. The provisions relating to abatement of Base Rent for delay in delivery set forth in Section 4 the First Amendment are superseded by the provisions of this Section 5.
Increase in Base Rent. [1] In the event that the ownership of the leased Property is conveyed to the LRA during the Term or a Renewal Term of this Sublease, as defined in Section 6 hereof, the Base Rent shall be increased by the LRA on a per square foot basis per annum to reflect any acquisition costs required by the Government with respect to the Leased Property to the paid to the Government by the LRA; provided, however, the LRA shall use its reasonable best efforts to obtain in a no cost economic development conveyance of the Leased Property from the Government. Such increase in Base Rent shall be effective as of the date of the LRA's acquisition of the Leased Property. Increase in Base Rent. The annual Base Rent payable under the Lease shall be increased by One Hundred Two and 50/100 Dollars ($102.50) per $1,000 of the Improvement Allowance disbursed pursuant to Paragraph 3 above, effective immediately as of the first day of the respective Adjustment Month. The increases in the annual Base Rent as a result of this Paragraph 4 of this Amendment shall be collectively referred to as the “Improvement Allowance Adjustment Amount.” Lessor shall provide Lessee with written notice of the then current annual Base Rent, as adjusted by the “Improvement Allowance Adjustment Amount”, at or prior to each disbursement made pursuant to Paragraph 3, above. To the extent such written notice of the then current Base Rent is not received by Lessee prior to the payment by Lessee of Base Rent for an Adjustment Month, then Lessee shall include any increased differential in Base Rent with the payment of the following month’s installment of Base Rent.
Increase in Base Rent. Base Rent payable under Paragraph C above --------------------- shall be increased annually commencing with the second lease year and each successive lease year thereafter during the Initial Term and any Renewal Term of this Lease by an amount equal to the product obtained by multiplying the annual Base Rent in effect immediately prior to the expiration of the current lease year, by a fraction, the numerator of which is the Index (defined below) most recently available immediately prior to the expiration of the current lease year, and the denominator of which is the Index most recently available immediately prior to the Commencement Date. In Landlord's sole discretion, the Base Rent for any lease year may be less than any increase described in this Section 3.D. and may be less than the Base Rent for the prior lease year.

(b) insurance required to be maintained by LESSOR for LESSEE under the Lease (exclusive of the insurance maintained by LESSEE under Paragraph 8.4 of the Lease), (c) Real Property Taxes, (d) reasonable reserves for replacement of the roof, reasonable reserves for exterior building painting, and reasonable reserves for paving maintenance, (a) assessments and dues payable to any association or other governing body established pursuant to any covenants, conditions or restrictions affecting the Premises as of the date of the Lease, (f) payment of Xxxxx Xxxx Bond installments, (g) afire sprinkler monitoring contract if payable separate from the fire sprinkler maintenance contract described in Paragraph 7.1(b) of the Lease, (h) the Administrative Fee described in subsection 4.3 of this Addendum, and (i) the reasonable amount of other ordinary and necessary expenses and costs of operation of the Premises, which are customarily incurred in the operation of similarly situated real estate projects; provided, however, the term "Operating Expenses" does not include (I) the costs of repairs or maintenance required to be performed by LESSEE to the extent such costs exceed the amount of any reserves accumulated from the Operating Expense collections for the particular repair or maintenance Item, or <PAGE> (II) any other items of expanse or cost which the terms of the Lease expressly require be paid or incurred by LESSEE, including all utility and trash charges payable by LESSEE under Paragraph 11 of the Lease. 4.1

Increase in Base Rent. Effective April 1, 2008 and every April 1st thereafter (each, an “Adjustment Date”), the Base Rent then in effect shall increase by a percentage equal to 85% of the increase in the previous twelve (12) months in the Consumer Price Index for All Urban Wage Earners and Clerical Workers (CPI-W) of the United States Department of Labor’s Bureau of Labor Statistics for All Cities, All Items (1982-84=100) in effect and generally published at the time the computation is to be made (the “Index”); provided however, that each increase of annual Base Rent shall not exceed five percent (5%) of the annual Base Rent for the immediately preceding Lease Year, and in no event shall the Base Rent be decreased in any Lease Year below the Base Rent payable in the immediately preceding Lease Year. In the event that an Index is not published as of any Adjustment Date during the term of this Lease, then the Index published immediately prior to the Commencement Date or the previous Adjustment Date, as the case may be, shall be used as the base year Index and the Index published immediately prior to the Adjustment Date of each year for which computations are made, shall be the Index used to establish the increase in the Index over the base year, or the last Adjustment Date, as the case may be. If the Index shall be discontinued a successor or comparable Index shall be selected by Landlord but if no such successor or comparable index shall exist, then Landlord and Tenant shall attempt to agree upon a substitute formula. If the parties are unable to agree upon a substitute formula, then Tenant shall pay Landlord the amount previously due under the Index and the disagreement between the parties shall be referred to and determined by arbitration, in accordance with the then prevailing rules of the American Arbitration Association, and judgment upon the award rendered shall be final and binding upon the parties and may be entered in any court of competent jurisdiction. Upon resolution of the arbitration the Landlord shall refund to Tenant or Tenant shall pay Landlord, as the case may be, any amount to be adjusted pursuant to the award. The Base Rent shall be divided into twelve (12) equal monthly installments and each such monthly installment shall be due and payable in advance on the first day of each month during each Lease Year, without setoff, deduction or demand.
