INCORPORATION OF RECITALS; EFFECTIVE DATE. The foregoing recitals are incorporated herein as an agreement of Borrowers, Administrative Agent and Lenders. The date of this Agreement is for reference purposes only. The effective date of Borrowers’, Administrative Agent’s and Lenders’ obligations under this Agreement is the date on which all of the conditions precedent in Section 1 above have been satisfied (the “Effective Date”).
INCORPORATION OF RECITALS; EFFECTIVE DATE. The foregoing recitals are incorporated herein as an agreement of Borrower and Lender. The date of this Agreement is for reference purposes only. The effective date of Borrower’s and Lender’s obligations under this Agreement is the date of recordation of the Amended Deed of Trust in the Official Public Records of Xxxxxx County, Texas (the “Effective Date”).

The date of this Amendment and the other Modification Documents (defined in Section 14(a), below), is for reference purposes only. The effective date (the "Effective Date") of this Amendment and the other Modification Documents is the date on which the conditions set forth in Section 14, below, have been satisfied or waived by all of the Lenders.

With the exception of the Borrower’s and Lender’s obligations under the Amended Note, the effective date of Borrower’s and Lender’s obligations under this Agreement is the date of recordation of the Short Form in the Official Records of Los Angeles County, California (the “Effective Date”). The effective date of Borrower’s and Lender’s obligations under the Amended Note shall be October 10, 2009.
