Incorporation of Proposal. Unless otherwise provided in this Contract, the Contractor's proposal is hereby made a part of the Contract. The Contractor's proposal may be subject to public disclosure in accordance with the Authority's Freedom of Information Policy. Notwithstanding the foregoing, however, the Authority will not publicly disclose commercial or financial information contained in the proposal which the Contractor specifically designates as confidential and provides the Authority with specific reasons protection is necessary.
Incorporation of Proposal. Requester may use the Human Tissue and Specimens only for the purposes stated in its Proposal and for no other purpose whatsoever.
Incorporation of Proposal. The Contractor’s original proposal and Best and Final Offer (if any) are hereby incorporated into and made part of this Contract as Exhibit 1. Disclosure of the Contract, proposal and Best and Final Offer and information contained therein to third parties shall be subject to the Article 2 of the Standard Provisions attached hereto as Exhibit 6, the Authority’s Freedom of Information Policy, and the Authority’s Contracting Manual.
Incorporation of Proposal. In addition to the rights, duties and responsibilities set forth in this Agreement, Summit shall perform its duties in accordance with the Proposal for the County by Summit and the County’s Request for Proposal. Wherever any of the terms and conditions set forth in Summit’s Proposal, the County’s Request for Proposal, or this Agreement conflict or are inconsistent, the parties agree that the conflict or inconsistency shall be resolved by applying the following order of document precedence:
Incorporation of Proposal. The Consultant’s Proposal dated (a copy which is attached hereto as Appendix “A”) (“Proposal”) including, but not limited to, the services set forth therein (“Services”) shall be incorporated by reference into this Agreement. In the event of a conflict between this Agreement and the Proposal, the terms set forth in this Agreement shall supersede the Proposal.
Incorporation of Proposal. In addition to the rights, duties and responsibilities set forth in this Agreement, Tiger shall perform its duties in accordance with the Proposal for the County by Tiger and the County’s Request for Proposal. Wherever any of the terms and conditions set forth in Tiger’ Proposal, the County’s Request for Proposal, or this Agreement conflict or are inconsistent, the parties agree that the conflict or inconsistency shall be resolved by applying the following order of document precedence:
Incorporation of Proposal. The terms of Xxxxxx’s proposal are hereby incorporated into this Lease. In the event of a conflict, the terms of this Lease shall control. (SIGNATURES ON FOLLOWING PAGE)
Incorporation of Proposal. Client acknowledges and agrees that all of the terms, conditions, limitations, exclusions, disclaimers, and requirements of the Proposal and the documents attached thereto, including all addenda or exhibits therein, are hereby incorporated into this Agreement.
Incorporation of Proposal. DUPONT’S proposal identified as Proposal No. 21P1856MORR4 dated April 19, 2022 and attached hereto is hereby incorporated by this reference as though set forth in full. In the event of any discrepancy between this Agreement and the Proposal, this Agreement will control.
Incorporation of Proposal. Requester may access the Human Anatomical Material only for the purposes stated in its Proposal and for no other purpose whatsoever. All Proposals submitted by the Requester during the access term of this Agreement will be governed by this Agreement. The Parties intend that Proposals shall be limited to the Requester’s use of the Human Anatomical Materials. The terms and conditions of any Proposal submitted by Requester in connection with the services provided under this Agreement shall not supersede or contradict this Agreement.
