Common use of Incidental Costs Clause in Contracts

Incidental Costs. The MCO must bear the sole expense of all costs to mitigate any harmful effect of any breaches or security incidents that were caused by the MCO or its subcontractors in violation of the terms of this Agreement. These costs include but are not limited to the cost of investigation, remediation, and assistance to the affected members, entities, or other authorities.
