In-Line Facilities. AEP shall have the sole right to operate, maintain, and at its option, to own any facilities that are required to be installed in-line with AEP’s facilities and that may affect the continuity and reliability of AEP facilities that provide or protect service to other customers.

In-Line Facilities. Unless provided otherwise by the SPP Tariff and/or unless Customer and AEP otherwise agree AEP shall have the sole right to operate, maintain, and at its option, to own any new facilities that (i) are required to facilitate Interconnection and Local Delivery Service pursuant to this Agreement, (ii) are to be installed in-line with AEP’s facilities, and (iii) may affect the continuity and reliability of AEP facilities that provide or protect service to other customers.
In-Line Facilities. Except as provided by subsection 2.5.3 below, switches, conductors and associated equipment, including support structures for such facilities, that are operated in-line with the AEP transmission system and are necessary to establish or expand a delivery point under this Agreement shall be provided, owned, operated and maintained by AEP.   • Facility Prudential is willing to consider, in its sole discretion and within limits which may be authorized for purchase by Prudential Affiliates from time to time, the purchase of Shelf Notes pursuant to this Agreement. The willingness of Prudential to consider such purchase of Shelf Notes is herein called the “Facility”.
