IN CONDITIONS. Should the U.S Coast Guard or any other U.S., state or government agency, port authority, terminal or association (including any pilot or pilot association), or any designee of any of the foregoing, issue any regulation or requirement that obligates XXXXX to make capital improvements to the Tugs, to provide Tugs with higher horsepower or different operational capabilities or that obligates XXXXX to operate the Tugs in a different manner or with a different crew complement that increases its operating costs, XXXXX shall have the right to propose amendments to the Rates, Terms and Conditions set forth in the Schedule in order to reflect the new requirements and, as applicable, mitigate the costs thereof. If OWNERS or those acting on behalf of the Vessel object to any said amendments the implementation thereof shall be stayed for a period of thirty (30) days and the parties shall negotiate in good faith to achieve a mutually satisfactory outcome. If the parties are unable to reach agreement within said thirty (30) day period, the amendments, as proposed by XXXXX, shall come into effect and the objecting party may terminate its obligations to XXXXX with respect to future Tug Services.

IN CONDITIONS. Prior to the introduction of any new types of equipment which alters a job classification and/or the establishment of new classifications for which rates of pay are not established by this Agreement, the Company shall advise the Union not less than thirty (30) days prior to implementation. The matter shall become the subject of discussion between the parties for wage rates governing the altered classification. If agreement on wage rates cannot be reached, the Company's wage rates will be put into effect, subject to the right of the Union to have recourse to the Grievance and Arbitration Procedures within sixty (60) days of the introduction of new classification.
IN CONDITIONS. XxXxxxxx Realty Management will continue to advertise and consider all other applications for the subject property until the following has been provided: • Application(s) have been received, paid, and all supporting documentation has been received. • Within 24 hours of your Approval by Management, a Good Faith Agreement & Commitment to Lease or the Lease Package forms must have been signed • Within 24 hours of your Approval the Good Faith Deposit has been received by Management • Failure to comply with these requirements will result in your application being closed and the property being released to the next applicant. • Certified Funds are required for all initial monies, including the Good Faith Deposit, Security Deposit, Pet Deposit (if any), a non-refundable administrative fee of $200.00 to Management, and Prorated Rent and/or First Month’s Rent.

  • CHANGE IN CONDITIONS Any changes to the condition of the site or work from the time of the proposal to the time when Company starts the work shall be the responsibility of the Customer. In the event of an increase in the work, the contract price shall be increased by a fair and reasonable valuation based upon the original contract rates. In either an increase or decrease in work, Customer shall provide an extra work notification to Company. Signing a time sheet is an automatic or extra work notification & serves as authorization of overtime pay.

  • Waiver of Conditions The conditions to each of the parties' obligations to consummate the Merger are for the sole benefit of such party and may be waived by such party in whole or in part to the extent permitted by applicable law.

  • Room Condition The university agrees to provide and the resident agrees to maintain the assigned room and all public areas in and around the immediate building(s) accessible to the resident in a clean, safe and sanitary condition. Upon termination of this agreement, the student should leave the assigned room, its furnishings, and its equipment in as good an order and condition as the same were upon commencement of the student’s occupancy, ordinary wear and tear excepted. University staff will complete an inventory of furnishings and an assessment of damages; charges will be assessed to the responsible individual(s). Personal property left in a room following the termination of occupancy will be deemed abandoned. Students will be charged for the removal of such property.

  • Failure of Conditions If the Conditions Precedent shall not have been satisfied or waived by February 27, 2015, either party may terminate this Lease and the Transfer Agreement by written notice of termination (the “Termination Notice”) delivered to the other party by February 27, 2015 (the “Failure of Conditions Termination Date”). Upon termination of this Lease under the terms of this Section 2, neither party hereto shall have any further claims or obligations under this Lease or the Transfer Agreement, except those obligations that expressly survive termination. Notwithstanding any provision of this Section 2.3 to the contrary, if the parties are unable to agree upon the initial Deferred Maintenance Items (as that term is defined in Section 9.2(c)(ii) below for the River Valley Facility to be included on Exhibit “E”, the sole remedy of the parties shall be to exclude the River Valley Facility from the Portfolio.
