In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees assignees, the prevailing party shall be entitled to recover any reasonable attorneys attorney’s fees and costs. iTrip, Mountain Vista Vacation Properties, or the Owner reserves the right to terminate this Agreement upon their individual discretion at any time. This property is advertised in good faith, and we shall strive to ensure the operation of all amenities in the Property. Homeowner and we shall not be held financially responsible for any such items’ failure to work, but will make efforts to correct reported issues as quickly as possible. This Agreement is for "Transient Rentals" only, and as such the renter has no tenant rights. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys attorneys’ fees and costs. Owner and iTrip Vacations North Shore Massachusetts reserves the right to terminate this Agreement upon their discretion at any time. The undersigned agrees to pay all collection costs, court costs, and legal fees incurred to collect delinquent balances from the rental or damage done to the property. This release is intended to be as complete and agrees comprehensive as the law permits, and to be comprehensive and universal with respect to all claims related to the use of the property by Tenant or its guests. Additionally, Tenant shall indemnify, defend and hold Owner free and iTrip harmless against and from any liability and claims of any claim kind for loss or suit damage to property of Tenant or any other person, or for any injury to or death of any person, arising there from. In any action concerning the rights, duties or liabilities out of Tenant’s use and occupancy of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys fees and costsproperty. Owner reserves the right to terminate this Agreement upon at their discretion at any time. This rental agreement is governed, construed, and interpreted by the laws of the State of Florida. Should it become necessary for the Owner and/or Owner’s Agent to employ an attorney to enforce the terms of this agreement, the Tenant shall pay all expenses and costs incurred for enforcement hereof, including reasonable attorney’s fees. All parties to this Agreement agree and consent to the exclusive jurisdiction and venue in either the Flagler County Circuit Court or Flagler County Circuit Court Small Claims Division, depending on the amount in dispute. This consent to jurisdiction applies regardless of the home state of the Tenant. Accordingly, if any damage to the Premises occurs beyond reasonable wear and tear, owner and/or owner’s agent shall be permitted to bring an action to recover such damages in the above-referenced courts against Tenant, in addition to all other remedies available in law or equity to Owner and/or Owner’s Agent. The undersigned Xxxxxx is responsible for the cost of any damages sustained to the property, décor or its contents during the stay; this includes the moving of items, the moving of items to another property, breakage or any excessive cleaning charges incurred during my stay. This also means that Tenant is responsible for any damage caused by Xxxxxx’s guests. By accepting this Agreement Tenant acknowledges that Tenant understands and accepts the terms and conditions of this Agreement. For purposes of this Agreement, you are both the principal for yourself and you are also the agent for all persons using the rental property under the terms of this Agreement. You understand and agree that it is your responsibility and duty to publish the terms of this Agreement to all persons who will use the rental property rented under the terms of this Agreement. You acknowledge and authorize iTrip to charge the credit card on file for any infractions, fees, or fines as outlined in this Agreement, any attempt to chargeback or dispute such charges with the credit card company is a breach of this Agreement providing iTrip all rights and remedies to pursue all damages and costs against you personally. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys attorneys’ fees and costs. Owner and iTrip Vacations North Shore Massachusetts reserves the right to terminate this Agreement upon their discretion at any time. Leases Six (6) months or less are considered 'Transient'. Transient accommodations or "short term rentals" are also subject to applicable New Hampshire Meals Tax or Massachusetts Occupancy Taxes. These taxes are added as a part of the total payment. Should the laws change regarding applicable taxes, iTrip Vacations North Shore Massachusetts will adjust the booking accordingly.

In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees assignees, the prevailing party shall be entitled to recover any reasonable attorneys attorney’s fees and costs. iTrip, Mountain Vista Vacation Properties, or the Owner reserves the right to terminate this Agreement upon their individual discretion at any time. This property is advertised in good faith, and we shall strive to ensure the operation of all amenities in the Property. Homeowner and we shall not be held financially responsible for any such items’ failure to work, but will make efforts to correct reported issues as quickly as possible. This Agreement is for "Transient Rentals" only, and as such the renter has no tenant rights. This release is intended to be as complete and agrees comprehensive as the law permits, and to be comprehensive and universal with respect to all claims related to the use of the property by Tenant or its guests. Additionally, Xxxxxx shall indemnify, defend and hold Owner free and iTrip harmless against and from any liability and claims of any claim kind for loss or suit damage to property of Tenant or any other person, or for any injury to or death of any person, arising there from. In any action concerning the rights, duties or liabilities out of Tenant’s use and occupancy of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorneys fees and costsproperty. Tenant authorizes Agent to use any and all comments, notes, reviews and guest book entries written by tenant or tenants guests in Agents marketing, social media posts, online reviews and other communications. Should it become necessary for the Owner and/or Owner’s Agent to employ an attorney to enforce the terms of this agreement, the Tenant shall pay all expenses and costs incurred for enforcement hereof, including reasonable attorney’s fees. All parties to this Agreement agree and consent to the exclusive jurisdiction and venue in either the Flagler County Circuit Court or Flagler County Circuit Court Small Claims Division, depending on the amount in dispute. This consent to jurisdiction applies regardless of the home state of the Tenant. Accordingly, if any damage to the Premises occurs beyond reasonable wear and tear, owner and/or owner’s agent shall be permitted to bring an action to recover such damages in the above-referenced courts against Tenant, in addition to all other remedies available in law or equity to Owner and/or Owner’s Agent.
