Hukukî Sonuçları. TBK md. 27/1‟e göre: “Kanunun emredici hükümlerine, ahlâka, kamu düzenine, kişilik haklarına aykırı veya konusu imkânsız olan sözleşmeler kesin olarak hükümsüzdür.” TBK md. 27/2 ise, kısmî hükümsüzlük halini düzenlemektedir. Bu hükme göre: “Sözleşmenin içerdiği hükümlerden bir kısmının hükümsüz olması, diğerlerinin geçerliliğini etkilemez. Ancak, bu hükümler olmaksızın sözleşmenin 50 Xxxxx-Xxxxxxx, s. 6; karş. Xxxxxxx‟e göre menfî zarar sözleşmenin geçerliliğine güvenden kaynaklandığı için bu güven ancak sözleşme tarafına ait ise korunur. Dolayısıyla menfî zararın tazmini talebi lehdara değil yalnızca sözleşme taraflarına ait olmalıdır: Xxxxxxx, s. 261. 51 Gernhuber, s. 501. yapılmayacağı açıkça anlaşılırsa, sözleşmenin tamamı kesin olarak hükümsüz olur.” Kanunda üçüncü kişi yararına sözleşme bakımından ayrık bir düzenleme olmadığına, sözleşme katılanlarının menfaati de ayrı bir amaçsal yorumu gerektirmediğine göre, bu düzenlemedeki kesin ve kısmî hükümsüzlük yaptırımı, üçüncü kişi yararına sözleşme bakımından da geçerli olmalıdır52. Sözleşme baştan itibaren kesin hükümsüz olduğundan, bunun sonucu lehdarın alacak hakkını kazanmamış olmasıdır. Lehdar hükümsüzlüğe rağmen vaadedene ifa talebinde bulunursa, vaadeden sözleşmenin hükümsüz olması dolayısıyla onun lehine bir alacak hakkı doğmadığı itirazında bulunabilir53. Üçüncü kişi yararına sözleşmede kısmî hükümsüzlük bakımından özellik arz edebilecek olan husus, sözleşmede sadece yetkilendirme kaydının veya bu kayda dayanarak yapılan lehdar belirlemesinin hükümsüz olması halidir. Uygulamada sözleşmeler çoğu zaman karşılıklı iki tarafa borç yükleyen sıradan sözleşmeler olarak düzenlenmekte, bu sözleşmeye bir yetkilendirme kaydı konularak tam üçüncü kişi yararına sözleşme elde edilmektedir54. Böyle durumlarda hükümsüzlüğün yalnızca yetkilendirme kaydını etkilemesi, vaadeden ve vaadettirenin karşılıklı edim yükümlülüklerine sirayet etmemesi mümkündür. Eğer durum bu ise, geriye geçerli bir sözleşme olarak ayakta tutulabilecek anlamlı bir bütün kalmaktadır. He may work alone frequently, but occasionally will require direction and instructions form Millwright I or A. Millwright 11: be capable, without direction of fitting, aligning and lubrication and taking apart and reassembling plant equipment. In addition, is expected to be able to weld, operate shop tools and do pipe fitting as required. Must under direction, become proficient at effective methods of trouble shooting and repairing hydraulic, pneumatic and mechanical faults in plant machinery. I: Must be capable without direction of performing all practices under Xxxxxxxxxx Must under directionbecomeproficient at reading and understanding blueprints, all phases of installing new equipment, laying out hydraulic and mechanical drives and meet speed and power requirements correctly.
