HOURS AND SHIFTS. Work scheduled for variable hour employees will be made based on availability. Notwithstanding needs that arise due to unforeseen circumstances, the Employer shall endeavor to make weekly work schedules available at a minimum of ten (10) days in advance. A variable hour employee scheduled to work on a shift which begins after 1:59 p.m. shall receive $1.35 per hour in addition to their regular hourly rate. A variable hour employee scheduled to work on a shift that begins after 9:59 p.m. shall receive $1.45 per hour in addition to their regular hourly rate. A variable hour employee who reports to work when their shift has been cancelled and were not notified of their shift cancellation shall be paid a minimum of four (4) hours. Where the scheduled shift is less than four (4) hours in duration, however, the employee shall be paid for the hours scheduled.

In case of future vacancies on regular shifts pertaining to uniform police duty (not detective, safety officer, motorcycle officer rescue assignments or administrative assistant or other special assignment) when the Chief decides to fill the vacancy, a notice stating and describing the vacancy shall be posted on the department bulletin board for seven (7) consecutive days. All eligible officers may bid upon said position. Within thirty (30) days, the Chief shall assign shifts or fill the vacancy according to seniority, unless in his judgment it would not be in the best interests of the Town or the department to do so, The judgment of the Chief of Police shall be final, unless his decision is not reasonably supported by the facts and he shall clearly state his reasons in writing at the request of the employee. ACS, ACO, Police Records Supervisor, Police Records Technicians and CSOs assigned to Traffic or Parking Enforcement shall work a four (4) day, ten (10) hour shift schedule. Communications Supervisors, Public Safety Dispatchers, and CSOs who are regularly assigned to the Patrol Section of the Police Department shall work a shift schedule consisting of a combination of 3-12 and 4-10 shift schedules. CSO hours worked during the 3-12 shift schedule shall be calculated based on 171 hours worked in a 28-day period for the purposes of determining overtime pursuant to the FLSA, and Employees shall continue to be paid on a bi-weekly basis.   • Devotion of Time and Effort Executive shall use Executive’s good faith best efforts and judgment in performing Executive’s duties as required hereunder and to act in the best interests of the Company. Executive shall devote such time, attention and energies to the business of the Company as are reasonably necessary to satisfy Executive’s required responsibilities and duties hereunder.
