Honouring Cards. Merchant will accept all valid Cards when properly presented by Cardholders in payment for goods or services, subject to applicable Card Association Rules requiring Merchant to elect whether to accept credit only, debit only or both debit and credit Cards. Xxxxxxxx’s election is set forth in the Merchant Application. Merchant may not establish minimum or maximum amounts for Card sales as a condition for accepting any Card. Merchant may not require any Cardholder to pay any part of any discount rate or other charge imposed upon Merchant by the Merchant Agreement. However, nothing herein shall prevent Merchant from offering discounts to customers for different methods of payment (e.g., cash, debit or credit card purchases) and differential discounts among different payment networks, provided any such discounts are clearly marked at the point-of-sale and not prohibited by Applicable Laws. Merchant may not engage in a Transaction (other than a mail, internet, telephone order, or preauthorized sale to the extent permitted under the Merchant Agreement) if the person seeking to charge the purchase to his or her Card account does not present the Card to permit Merchant to compare the signature on the Card to the signature on the Sales Draft and obtain an Imprint or otherwise use the physical Card to complete the Transaction.

Notwithstanding the foregoing, Merchant may impose a Surcharge or Convenience Fee on Transactions, to the extent permitted under applicable Law and the Card Association Rules. Merchants have the right to provide discounts to customers based on any method of payment selected by the customer. Any discounts must be clearly marked at the point of sale. Merchant may not engage in a Transaction (other than a mail, internet, telephone order, or preauthorized sale to the extent permitted under the Merchant Agreement) if the person seeking to charge the purchase to his or her Card account does not present the Card to permit Merchant to compare the signature on the Card to the signature on the Sales Draft and obtain an Imprint or otherwise use the physical Card to complete the Transaction. Merchant must ensure that the Cardholder is easily able to understand that the Merchant is responsible for the Transaction, including delivery of the goods (whether physical or digital) or provision of the services that are the subject of the Transaction, and for customer service and dispute resolution, all in accordance with the terms applicable to the Transaction. Xxxxxxxx must not engage in any acceptance practice that discriminates against or discourages the use of a Card in favour of any other acceptance brand. Advertising. Merchant will prominently display the promotional materials provided by Peoples Trust in its place(s) of business as it relates to Card Present transactions. Merchant’s use of promotional materials and use of any trade name, trademark, service mark or logo type (“Marks”) associated with a Card is limited to informing the public that the Card will be accepted at Merchant’s place(s) of business. Merchant’s use of promotional materials and Marks is subject to Peoples Trust’s direction and to the Card Association Rules. Merchant may use promotional materials and Marks only during the term of the Merchant Agreement and will immediately cease use and return any inventory to Peoples Trust upon termination thereof. Merchant may not use any promotional materials or Marks associated with Visa, MasterCard or Interac in any way which suggests or implies that either endorses any goods or services other than Card services.
Honouring Cards. 3.1 In effecting Card Sales, the Merchant will honour properly tendered Cards and will not discriminate between Cardholders and cash customers or between Cardholders of different Cards. The Merchant will sell Merchant's goods and/or services at its regular cash prices, including any special sales price then in effect, without service or carrying charges of any kind and will make no special charge (including what is commonly known as a "surcharge") or extract any special agreement, condition or security from a Cardholder and without otherwise requiring any Cardholder to pay any part of the discount charged by the Merchant hereunder and will not refuse to exchange, return, or adjust merchandise purchased if any such exchange, return or adjustment is permitted to cash customers.
Honouring Cards. 2.2 The Merchant agrees to honour in accordance with the conditions set out in this Agreement, any Qualified Card properly tendered by any bona fide Cardholder to the Merchant for use in a Transaction.
