D. Any holiday as determined declared by proclamation of the Mayor shall not be deemed to advance the last scheduled working day before a holiday for purposes of computing any additional time off.
E. The unspecified holidays shall be taken in accordance with the following requirements:
1. The holidays shall be credited on January 1 of each calendar year and must be taken in one full normal working day increment of eight (8) hours during the calendar year in which it is credited or it will be forfeited. The request for such time off, if timely submitted by the Chief employee, will be promptly approved by the City subject to the operating needs of Policethe employee's department, office, or bureau. If an unforeseen operating requirement prevents the employee from taking such previously approved holiday, the City will reschedule the holiday so that it may be taken on some other reasonably satisfactory date within the calendar year.
d2. Any break in service (i.e., resignation, discharge, and retirement) In order prior to taking the holidays shall forfeit any right thereto.
3. The holidays shall not be eligible for holiday payutilized to extend the date of any layoff.
4. No employees shall be entitled to the unspecified holidays upon appointment to one of the classifications represented by the Association until the employee has completed six months of satisfactory City service.
5. No employee shall receive more than two unspecified holidays each calendar year. Thus, (a) an employee must be on transferring from the active payroll Department of Water and Power (DWP) to any other City department, office or bureau will not receive an unspecified holiday after taking such holiday prior to leaving DWP, and (b) employees who resign or are terminated and then rehired during the City and must have worked his/her full regularly scheduled workday before and after the holidaysame calendar year, unless excused by the Citywill not receive additional unspecified holidays when rehired if such a holiday had been taken prior to resignation or termination.
e) Holidays occurring F. Whenever a holiday from 1 through 12 above occurs during an employee's vacation period regularly scheduled work week, eight (8) hours of paid leave shall not be counted credited for the purpose of computing overtime pay for work performed after forty (40) hours.
G. Whenever a holiday listed under 13 and/or 14 above occurs during an employee’s regularly scheduled workweek, the appropriate number of hours of paid leave shall be credited for the purpose of computing overtime pay for work performed after forty (40) hours.
H. Whenever a holiday falls on an employee’s 9/80 or modified day off, the employee shall take an alternate day off within the same calendar week as vacationthe holiday.
I. For each holiday listed above which results in time off with pay for employees working a Monday through Friday work week, but will employees who are scheduled to work other than the Monday through Friday work week shall be paid entitled to such day off with pay or shall be compensated in accordance with Article 8all pertinent provisions (B through H above). If such holiday falls on the employee's scheduled day off, Section (a) abovean alternative day off in-lieu shall be scheduled within the same calendar week.
f) When an employee is required by order of J. (g) An The Floating Holiday/Birthday listed in sections (a) and (b) shall be a total of thirty (30) hours per year and must be taken during the fiscal year. (a) Worked the regularly scheduled workday preceding and the regularly scheduled workday succeeding the holiday, unless an absence for one of such days shall be excused for good cause, substantiated by the employee, or
(b) Been at work in the two (2) weeks preceding said holiday and laid off during such preceding two (2) weeks, or
(c) Is on a bona fide leave of absence starting within the two (2) weeks immediately preceding such holiday, or on the workday immediately following such holiday, or
(d) If no work is scheduled between two (2) holidays, to be eligible for pay for both holidays, an employee must work his/her preceding scheduled workday and his/her scheduled workday succeeding such holidays. To be eligible for pay for one (1) full regularly scheduled shift of paid time off as a floating holiday to be taken during the fiscal year. d) In order to be eligible for holiday payholidays, an employee must be on the active payroll of the City and must have worked work either his/her full regularly scheduled workday before and after preceding the holiday, unless excused by the City.
e) Holidays occurring during an employee's vacation period shall not be counted as vacation, but will be paid in accordance with Article 8, Section (a) above.
f) When an employee is required by order of the Chief of Police to work first holiday or his/her regularly scheduled work hours on a workday succeeding the second holiday, if eligible for holiday pay, in addition to his/her holiday pay he/she shall receive one and one-half times his/her regular hourly rate of pay for each hour or major fraction worked, up to a maximum of his[her regularly scheduled work hours for that day.

In addition to the employee's birthday eight (8) hours holiday pay, double time off, each for all time worked. An employee shall be eligible for holiday pay who shall have been employed for a period of sixty (60) calendar days before such holiday and has met one of the hours equal following additional conditions:
(a) Worked the regularly scheduled workday preceding and the regularly scheduled workday succeeding the holiday, unless an absence for one of such days shall be excused for good cause, substantiated by the employee, or
(b) Been at work in the two (2) weeks preceding said holiday and laid off during such preceding two (2) weeks, or
(c) Is on a bona fide leave of absence starting within the two (2) weeks immediately preceding such holiday, or on the workday immediately following such holiday, or
(d) If no work is scheduled between two (2) holidays, to be eligible for pay for both holidays, an employee must work his/her preceding scheduled workday and his/her scheduled workday succeeding such holidays. To be eligible for pay for one (1) full regularly scheduled shift of paid time off as a floating holiday to be taken during the fiscal year. Effective July 1, 2016, each employee shall be eligible for the hours equal to two (2) regularly scheduled shifts of paid time off as floating holidays to be taken during the fiscal year. (f) The Floating Holiday/her Birthday listed in section (a) shall be a total of thirty (30) hours per year and must be taken during the fiscal year. The time during the year which the employee may take this time off shall be determined by the Chief of Police or their designee after giving consideration to the operating requirements of the department. However, the time off request shall not be unreasonably denied.
(g) For calculation of payment under this Article, regular hourly rate of pay for each hour or major fraction workedshall include: Special Pays an employee receives, up to a maximum of his[her regularly scheduled work hours for that day.
g) An employee may elect either to be such as Motorcycle Duty, Acting Pay (when paid for holiday all hours assigned), Training Officer Pay (when assigned for the pay period), Investigator Pay (when assigned for the pay period), Hazardous Pay, Field Force Pay, and overtime work or may elect to accumulate compensatory time in lieu of pay pursuant to Article 18Senior Officer Pay; Special Assignment Pays; Longevity Pay; Bilingual Pay; and Education Pays.

(b) Each employee will be eligible for the equivalent of their regularly scheduled shift eight (8) hours of paid time off at the regular base hourly rate to be given in observance observation of the anniversary of the employee's birthday to be used within the fiscal year in which earned. In addition to the employee's birthday time off, each employee shall be eligible for the hours equal to one (1) full regularly scheduled shift of paid time off as a floating holiday to be taken during the fiscal year. Effective July 1, 2016, each employee shall be eligible for the hours equal to two (2) regularly scheduled shifts of paid time off as floating holidays to be taken during the fiscal yearbirthday. The time during the year which the employee may take his/her his birthday time off shall be determined by the Chief of Police after giving consideration to the operating requirements of the department.
(c) For employees regularly scheduled a Monday-Friday Monday‑Friday workweek, whenever one of these holidays falls on a Saturday, the preceding Friday will be observed as a holiday; and should it fall on a Sunday, the following Monday would be a holiday. For employees regularly scheduled on an other than Monday-Friday Monday‑Friday workweek, whenever one of those holidays falls on a non-workdaynon‑work day, the previous or subsequent workday shall be observed as that holiday as determined by the Chief of PolicePolice Chief.
(d) In order to be eligible for holiday pay, an employee must be on the active payroll of the City and must have worked his/her his full regularly scheduled workday before and after the holiday, unless excused such conditions are specifically exempted, in writing, by the City.
(e) Holidays occurring during an employee's vacation period shall not be counted as vacation, but will be paid in accordance with Article 8, Section (a) above.
(f) When an employee is required by order of the Police Chief of Police to work during his/her regularly scheduled work hours on a holiday, if eligible for holiday pay, pay in addition to his/her holiday pay pay, he/she shall receive one and one-half (1-1/2) times his/her regular base hourly rate of pay for each hour or major fraction worked. Effective the first full pay period July, up 2011 the one and one-half (1-1/2) times base shall be reduced to one (1) times his base hourly rate of pay for each hour or major fraction worked. Effective the first full pay period in July, 2013 the one and one-half (1-1/2) times overtime rate shall be reinstated.
(g) Effective July 1, 2011 t The Floating Holiday/Birthday listed in sections (a) and (b) shall be increased to a maximum total of his[her regularly scheduled work thirty (30) hours for that day.
g) An per year and must be taken during the fiscal year. The time during the year which the employee may elect either to take this time off shall be paid for holiday and overtime work determined by the Chief of Police or may elect to accumulate compensatory time in lieu of pay pursuant to Article 18.
h) An employee who is on suspension from employment with the City and has a holiday fall during his/her suspensiondesignee after giving consideration to the operating requirements of the department. However, the time off request shall not be unreasonably denied.
(h) For calculation of payment under this Article, base hourly rate shall be credited with having served twoincreased by Investigator assignment pay, or FTO assignment pay, or Senior Officer premium pay for any employee so assigned by payroll action form.

(a) Worked the regularly scheduled workday preceding and the regularly scheduled workday succeeding the holiday, unless an absence for one of such days shall be excused for good cause, substantiated by the employee, or
(b) Been at work in the two (2) weeks preceding said holiday and laid off during such preceding two (2) weeks, or
(c) Is on a bona fide leave of absence starting within the two (2) weeks immediately preceding such holiday, or on the workday immediately following such holiday, or
(d) If no work is scheduled between two (2) holidays, to be eligible for pay for both holidays, an employee must work his/her preceding scheduled workday and his/her scheduled workday succeeding such holidays. HOLIDAYS AND HOLIDAY PAY. (g) An employee may elect either to be paid for holiday and overtime work or may elect to accumulate compensatory time in lieu of pay pursuant to Article 18.
(h) An employee who is on suspension from employment with the City City, and has a holiday fall during his/her their suspension, shall be credited with having served twotwo (2) days suspension for that holiday date.
(i) For calculation of payment for holiday worked, an employee may elect, in lieu of regular pay, to have their base pay (without special assignment pay) increased by an amount equivalent to their longevity pay for the biweekly pay period broken down into an hourly rate times the holiday hours worked. The procedure for this election will be by department policy.
