Common use of Holding Over Clause in Contracts

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be two hundred percent (200%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be one hundred fifty percent (150%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month-to-month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises after expiration or any part thereof termination of the term, or after the expiration date of the term hereofany notice given by Lessor to Lessee terminating this lease, such occupancy possession by Lessee shall be deemed to be a month-to-month tenancy from month terminable on thirty (30) days' written notice given at any time by either party. The rent paid shall be equal to month upon all the last monthly payment made by Lessee to Lessor. All provisions of this Lease lease except those pertaining to term shall apply to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month-to-month tenancy.

If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be one hundred twenty-five percent (125 %) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusaloptions, if any, granted under the terms of this Lease Lease, shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises Promises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during after the commencement of said month to month tenancy.

Holding Over. If Paragraph 26 hereof notwithstanding, if Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, ; such occupancy shall be a tenancy from month to month upon all the provisions of this the Lease pertaining to the obligations of Lessee, but except that the monthly rental rate shall increase by ten percent (l0%) and all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further force or effect during said month to month tenancy.

Holding Over. If Lessee, with LessorXxxxxx's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be two hundred percent (200%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy. 27.

If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be one hundred twenty percent (120%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

If Lessee, with Lessor's consent, consent remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month-to-month upon all the provisions of this the Lease pertaining to the obligations of Lessee, but all options and rights of first refusaloptions, if any, any granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month-to-month tenancy.

Holding Over. If the Lessee, with Lessor's written consent, remains in possession of the Premises premises after expiration or any part thereof termination of the term, or after the expiration of date in any notice given by the term hereofLessor to the Lessee terminating this lease, such occupancy possession shall be deemed to be a month-to-month tenancy from month to month upon all the terminable on thirty days' written notice given at any time by either party. Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part party thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy. Such continued occupancy shall be at a rate of 125% of the amount being paid by the lessee the last month of the term hereof.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed deeded terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all of the provisions of this Lease pertaining to the obligations of Lessee, except that the monthly rent shall be 120% of the rent payable in the last month of the lease term but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Anything to the contrary notwithstanding, any holding over by Lessee without Lessor's prior written consent shall constitute Lessee's Major Default hereunder without notice or cure period and shall be subject to all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancyremedies set forth herein.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term terms hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be two hundred percent (200%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall by one hundred twenty-five percent (125%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy. See Addendum No. 5.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be -----125%----- of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. Holding Over. If Lessee, with Lessor's consentconsents, remains in possession of the Premises or on any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be (See Paragraph 61) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereofterm, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy. 25.

Holding Over. If Lessee, with Lessor's consent, remains Lessee shall remain in possession of the Premises or any part thereof after the expiration or sooner termination of the term hereofthis Lease, such occupancy shall shall, at the sole option of Lessor, be a tenancy from month to month upon all the of terms and provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall hereof. Said monthly tenancy may be deemed terminated and be of no further effect during said month to month tenancyby Lessor upon giving Lessee prior written notice.

Holding Over. If Lessee, with or without Lessor's consent, remains in possession of the Premises Leased Premises, or any part thereof pad thereof, after the expiration or termination of the term Term hereof, such occupancy shall shall, at Lessor's sole option, be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancyLease.

Holding Over. 35.1 If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all except that the monthly rental shall be at a rate of one and one-half (1 1/2) times the last monthly rental paid by Lessee. All options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.

Holding Over. If Lessee, with Lessor's consent, Lessee remains in possession of the Premises or any part thereof after the expiration of the term hereofof this Lease, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, 's obligations. Any option granted under the terms of this Lease to Lessee hereunder shall be deemed terminated and be of no further effect during said month to month tenancyterminated.

Holding Over. If Lessee, with Lessor's consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, hereof such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy. Rent during any hold over period shall be subject to 50% increase over the rent due during the last month prior to expiration of the Lease.

Holding Over. If Lessee, with Lessor's consent, Lessee remains in possession of the Premises or any part thereof with Lessor’s consent after the expiration of the term hereofof this lease without having exercised any option to renew this lease, or after the termination of any such option period, such occupancy possession by Lessee shall be construed to be a tenancy from month to month upon all the month-to-month, terminable on thirty (30) days’ notice given at any time by either party. All provisions of this Lease lease, except those pertaining to term, shall apply to the obligations of Lessee, but all options and rights of first refusal, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month-to-month tenancy.

Lessee shall pay Lessor rent in the amount of 150% of this Lease’s last month’s rent during any such hold over period.

Holding Over. If Lessee, with Lessor's ’s consent, remains in possession of the Premises or any part thereof after the expiration of the term hereof, such occupancy shall be a tenancy from month to month upon all the provisions of this Lease pertaining to the obligations of Lessee, but except that the rent payable shall be Two hundred percent (200%) of the rent payable immediately preceding the termination date of this Lease, and all options and rights of first refusalOptions, if any, granted under the terms of this Lease shall be deemed terminated and be of no further effect during said month to month tenancy.
