Historical Performance Information. To the extent agreed upon by the parties, the Sub-Advisor will provide the Trust with historical performance information on similarly managed investment companies or for other accounts to be included in the Prospectus or for any other uses permitted by applicable law.

To the extent agreed upon by the parties, the Sub-Advisor will provide the Advisor with historical performance information for mutual funds affiliated with the Sub-Advisor for which the Sub-Advisor serves as investment advisor that have investment goals and strategies similar to those of a Fund of the Trust for which the Sub-Advisor serves as sub-advisor; the Sub-Advisor shall have no liability or responsibility for the Advisor’s use of such performance information.
Historical Performance Information. To the extent agreed upon by the parties, the Sub-SubAdviser will provide the Fund and the SubAdviser with historical performance, fee and expense information about the composite of accounts and investment companies the Sub- SubAdviser manages that have investment objectives, policies, and strategies substantially similar to those employed by the Sub-SubAdviser in managing the Allocated Assets, to be included in the Prospectus or for any other uses permitted by applicable law or to permit the Adviser and SubAdviser to satisfy their supervision and oversight responsibilities as required under applicable law.
