The Higher Classifications clause defines how goods or services may be classified under broader or more general categories for regulatory, tariff, or contractual purposes. Higher Classifications. 36.1 Where a client of the employer employs mechanical trade maintenance employees at the relevant client site, to perform the same work as employees covered by this agreement, and such client employees are classified at a higher classification than normal, the relevant employee of the employer shall be paid the same rate of pay as that equivalent client employee for the duration of the assignment at that client site. Where the guidance highlights shortcomings in a particular platform the Supplier may wish to use, then these should be discussed with the Customer and a joint decision shall be taken on whether the residual risks are acceptable. Where the Supplier wishes to deviate from the CESG guidance, then this should be agreed in writing on a case by case basis with the Customer. The Supplier and Customer recognise the need for the Customer Data to be safeguarded under the UK Data Protection regime or a similar regime. To that end, the Supplier must be able to state to the Customer the physical locations in which Customer Data may be stored, processed and managed from, and what legal and regulatory frameworks Customer information will be subject to at all times. The Supplier shall agree any change in location of Customer Data storage, processing and administration with the Customer in advance where the proposed location is outside the UK.
