HEALTH WARRANTY. Member and Buyer represent that Member is in good health and has no disability, impairment medical condition or illness preventing Member from engaging in exercise, use of Crunch facilities or that poses a health risk to other users of the Gym. Member and Buyer assume full responsibility for Member’s medical condition as it relates to his/her ability to engage in exercise. Member and Buyer agree that Member will not use any of Crunch facilities with open cuts, abrasions, sores, infections, contagious conditions or maladies which may impose a health risk to others in accord with state and local health requirements. Crunch Management reserves the right to prohibit or limit the use of its facilities to Members with such conditions in accord with state and local health requirements.
HEALTH WARRANTY. 5.1. The warranty period is one year, from date of purchase. This warranty covers against fatal and life altering congenital diseases. This includes severe hip dysplasia which hampers the dog's movement and kidney, heart, pancreas, spine and liver problems of a severe, life threatening or altering nature. If the dog dies within the warranty period, the buyer must pay to have the animal autopsied to determine the reason of the death. If the reason is found to be congenital, the seller will replace the puppy by other with similar characteristics but will not refund money. There is no cash refund of any kind, in full or partial. The replacement puppy will be of equal value.
HEALTH WARRANTY. If Buyer satisfies the conditions of this Section 5, for a period of thirty (30) months from the Puppy’s date of birth, Breeder warrants that the Puppy will not have any inherited genetic defects that would be life threatening or materially life altering. This genetically inherited health warranty includes all internal organs and issues that are not visible on a routine physical examination. If an inherited genetic defect is found and Xxxxx has complied with the conditions of this Contract and warranty, Xxxxx’s solace and exclusive remedy will be to receive, at Breeder’s sole option, either a replacement puppy of same sex and color in the next available litter or cash refund of the Purchase Price. Xxxxx must return the Puppy to Breeder prior to receiving replacement puppy or refund. Buyer is solely responsible for all shipping expenses related to return of the Puppy and receiving a replacement puppy. This warranty is non-transferable.

HEALTH WARRANTY. The Employee warrants that he is not aware of any condition, symptom or circumstance arising from his employment with the Company that may result in the Company being liable to him for damages for personal injury.
HEALTH WARRANTY. Seller warrants that the purchased canine shall be sound and free from genetic trauma or pathologic defect for a period of one year from date of purchase. Radiographs of hips, and elbows shall be provided to the Buyer. Radiographs will are reviewed by two licensed veterinarians prior to delivery to Buyer to assure they are acceptable for a working dog. Purchasing agency shall have the option to have departmental veterinarian review radiographs at their discretion. Any preventable disease, trauma, or infection, which may occur, is the responsibility of the Buyer during the warranty period of time. Any and all medical evaluations conducted on the dog shall be available to Sellers veterinarian. Should an agreed medical evaluation of the purchased dog shows that this dog is permanently eliminated from performing its trained duties, and meets the specifications for replacement above, Seller shall replace the dog. Buyer shall arrange delivery of the purchased dog to the Seller and Seller shall have a suitable replacement dog available for the Buyer. Canine shall be free of heart worms and be on preventive medications at Buyers locations prior to presentation for sale.
HEALTH WARRANTY. Other than the details provided in Exhibit A below, Client represents and warrants to Company that he or she is in good physical condition and has no medial reason or impairment that could prevent the Client from his or her indented use of Company’s gym facilities. Client acknowledge that Company has not given Client any medical advice before Client joined the Company’s gym and cannot give Client any such advice after Client joins the Company’s gym, whether related to the Client’s physical condition and ability to use the facilities and services of the Company’s gym or otherwise. Client also acknowledges and agrees that he or she will disclose any and all heart or medical concerns with the Company prior or and while using the Company’s facilities in order to prevent any medical injuries from occurring.
HEALTH WARRANTY. The Dog will be delivered in good health and to the best of Seller’s knowledge, free from genetic defect. Seller has taken every reasonable precaution to ensure the physical soundness and temperament of the Dog. To the best of Seller’s knowledge, the Dogs’ sire and dam are free of hereditary defect. Upon receipt of the Dog, Buyer has 72 hours to take the Dog to a veterinarian of its own choice to determine the Dogs’ physical condition. If Buyer is satisfied with the veterinarian report, Buyer will retain possession of the Dog and thereafter hold Seller harmless from any loss, damage or cost resulting from the general health of the Dog. If the Dog is found to be in a general state of poor health or is found to be seriously ill by the veterinarian’s report, Buyer shall immediately provide Seller with a copy of such report and may elect to return the Dog to the Seller within three (3) days of the veterinarian examination at Seller’s expense. Seller will replace the Dog or refund the amount paid, at Seller’s option. SELLER ASSUMES NO RESPONSIBILITY FOR ANY HEALTH RELATED ISSUES OR LOSS OF LIFE DUE TO REACTIONS CAUSED BY VACCINATIONS OR FLEA AND TICK PREPARATIONS ADMINISTERED EITHER ORALLY OR ON THE SKIN SURFACE. Seller Initials: Buyer Initials: For any Dog that is under the age of two on the date of signing this agreement, the following genetic guarantees will apply: If the Dog dies from a genetic illness or defect within two years of its whelp date (but not because of a condition caused by or contracted while in the Buyer’s possession), the Dog will be replaced as soon as a replacement Dog is available, or Seller will, at Seller’s option, refund the purchase price. A certified written report from a licensed veterinarian of Buyer’s choice and own expense will need to be submitted to verify a genetic illness or defect. Seller reserves the right to get a second opinion at its own expense. This warranty applies only to the Buyer and is not transferable to a subsequent owner.
HEALTH WARRANTY. Each member represents to Elysium Tennis that he/she is physically fit to perform all those activities which he/she undertakes at Elysium Tennis and that he/she understands all the health risk associated with such activities.
