Health, Safety & Environment. 25.01 The Employer, the Union and the employees shall promote and maintain standards of general office and Plant safety. The Employer and its employees shall comply with all applicable federal and provincial health and safety legislation and regulations. It shall be the objective of the Health, Safety and Environment Program to eliminate accidents and health hazards. To that end, the parties agree to create a:
Health, Safety & Environment. 9.01 The parties agree that they mutually desire to maintain standards of safety and health in the facility in order to prevent injury and illness.

Health, Safety & Environment. The Supplier warrants that it and its employees shall comply with all legal and governmental health, safety and environmental regulations, and of the Buyer and the Buyer’s customer HSE requirements including work site procedures.

Health, Safety and Environment (HS&E) The Company will recognize an HS&E Committee consisting of three (3) Company representatives and three (3) Union representatives that may be from the Grievance Committee. This committee will act as an advisory committee to promote and assist the Company in maintaining a safe and healthy place to work. This committee will bring to the attention of the Company any unsafe or unhealthy conditions or environmental concerns in the plant, and participate in issue resolution and communications. The HS&E Committee will meet on a need basis, but in any event, not less than monthly. The Company shall continue to make reasonable provisions for the safety and health of its employees during the hours of their employment. An employee or Union Xxxxxxx shall draw any HS&E concern to the attention of the immediate Team Manager who shall review the concern with the employee and/or Union Xxxxxxx. In the event the concern remains unsolved, the appropriate HS&E representative will review the concern. In the event the concern still remains, a Union representative of the HS&E Committee will review and attempt to resolve the concern. If the job is considered safe by the Team Manager and the HS&E representative(s), the employee shall be required to perform it. When an HS&E representative is not available on the second and third shifts, the concern will be reviewed by a Management representative and a Union representative. If a more detailed review is needed, the appropriate HS&E representative(s), the Team Manager and the Union representative involved will fully investigate the concern and the Company will render a decision. Should the decision of the HS&E representative not satisfy the Union and/or employee involved, the Union Business Representative will attempt to resolve the concern with the HS&E Director and shall be subject to the grievance procedure thereafter, beginning at Step 3. The Company, as it deems necessary, may have the Medical Department make such physical examinations of its employees as considered advisable to determine the physical fitness of employees for their jobs and to determine any health hazards. The Company will continue to provide necessary protective equipment for the use of employees.

In the interest of personal safety, all employees have an obligation to: • Comply with all safe work practices, rules, procedures and instructions with the intent of avoiding injury to themselves and others, damage to plant or equipment and environmental pollution. • Take reasonable care for the health and safety of themselves and others. • Wear personal protective equipment and clothing where required. • Comply with any reasonable direction given by Management for environmental, health and safety. • Not misuse or interfere with any environmental or health and safety equipment provided. • Report all near misses, accidents and incidents on the job immediately. • Report all known or observed hazards to their Supervisor or Manager immediately.

It is a condition of employment that employees comply with their obligations under the Health and Safety laws and abide by the Company’s policies, procedures and requirements to ensure a safe working environment for all employees, customers and the general public. Employees shall follow and abide by the policies and procedures of customers to ensure a safe working environment. If any employee is unsure of particular policies and procedures then they shall ask the Company to clarify these.
Health, Safety & Environment. The SELLER shall not be responsible in any respect whatsoever for any loss, damage or injury resulting from any hazards inherent in the nature of any Marine Fuel. The BUYER shall at all times comply with any obligations, requirements, recommendations and/or industry best practices whether made by the SELLER or contained in any law, statute, directive or regulation of any territory, state or jurisdiction in or through which the Marine Fuels may be delivered, sold, transported or used and all Government, state or local regulations at the port such as, but not limited to, those related to fire, or loss of Marine Fuel. If an escape, spillage or discharge of oil (hereinafter referred to as a “Spill”) occurs while Marine Fuel is being delivered to BUYER hereunder, BUYER will promptly take such action as is reasonably necessary to remove the oil and mitigate the effects of such Spill. However, notwithstanding the cause of such Spill, SELLER or its suppliers are hereby authorised, at its option, upon notice to BUYER, or the receiving vessel, to take such measures, either in cooperation with BUYER, or exclusively as the sole party, and incur such expenses (whether by employing its own resources or by contracting with others) as are reasonably necessary, in the judgment of SELLER or its suppliers to remove the oil and mitigate the effects of such Spill. If SELLER has exercised its option to remove the oil and mitigate the effect of such Spill, BUYER agrees to cooperate and render such assistance as is required by SELLER in the course of such action. Any expenses, damages, costs, fines and penalties arising from escape, spillage, discharge or pollution of oil shall be paid by the party that caused such escape, spillage, etc by a negligent act or omission. If both parties have acted negligently, any expenses etc shall be divided between the parties in accordance with the respective degree of negligence.

Preamble The Employer acknowledges to make all reasonable and proper provisions for the maintenance of high standards of health and safety in the workplace, including a properly heated, ventilated and lighted working environment that is as free as possible of pollution.
Health, Safety & Environment. 17.01 The Company, Union and Local Union acknowledge their common concern for maintaining a healthy and safe working environment. In order to effect a thoroughly understood and accepted health, safety and environment program for employees at work it is agreed that joint and co-operative methods shall be encouraged. To this end, joint Health, Safety and Environment Committees will be established for the Operations as set out in Schedule 'J' attached to this Agreement. In addition, the Union, the Executive of the Local Union and, at the request of the Executive of the Local Union, the General Health, Safety and Environment Committee of the Local Union shall have the right at any time to discuss matters dealing with health, safety and environment conditions affecting employees while at work.
